An Act to amend the Law relating to Road Boards.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Road Boards Acts Amendment Act, 1905”
; and it shall form part of and be read together with “The Road Boards Act, 1882”
(hereinafter referred to as “the principal Act”
).
2 How special orders made.
(1.)
Where anything is required by the principal Act to be done by “special order”
it shall be done in the following manner:—
(a.)
The resolution to do such thing shall be passed at a special meeting.
(b.)
Such resolution shall be confirmed at a subsequent meeting (either ordinary or special) held not sooner than the twenty-eighth day and not later than the fifty-sixth day after such special meeting.
(c.)
Public notice of the time and place fixed for such subsequent meeting, and of such resolution, shall be given once in each of the four weeks immediately preceding the day on which the subsequent meeting is to be held, and a notice of such meeting shall be given to each member.
(d.)
In publicly notifying the resolution making any special order it shall not be necessary to set out the whole of the proposed order if the object or purpose of the same be stated, and if a copy of the proposed special order be deposited at the office of the Board, and, if the Board thinks fit, at some other place or places in the road district or part of the road district specified in the notification, and be open to the inspection of the public during office hours for at least twenty-one days immediately preceding the day appointed for the holding of the subsequent meeting.
(2.)
Section seventy-five, and the words “except in the case referred to by section seventy-five hereof”
in section seventy-eight, of the principal Act are hereby repealed.
3 Section 99 of principal Act amended.
Section ninety-nine of the principal Act (relating to the withdrawal of money from the Road Board Account) is hereby amended by repealing all words after “Countersigned by,”
and substituting in lieu thereof the words “any two of such of the members as the Board from time to time authorises to sign cheques.”
