The Short Title of this Act is “The Public Trust Office Amendment Act, 1905”; and it shall form part of and be read together with “The Public Trust Office Consolidation Act, 1894” (hereinafter referred to as “the principal Act”).

Section thirteen of the principal Act is hereby amended by repealing all the words in the first paragraph thereof from and including “Trustees, whether appointed” to “sole trustee in their place.”

Trustees, whether appointed before or after the coming into operation of the principal Act, and whether appointed under a deed, deed-poll, or will, may, unless expressly prohibited, and notwithstanding the terms of the trust as to the number of trustees, appoint the Public Trustee (if he consents thereto) sole trustee in their place without obtaining the consent of the Supreme Court or a Judge thereof.

Executors whose duties continue in the nature of a trusteeship after their administration is closed shall for the purposes of the last preceding subsection be deemed to be trustees.

Where the Public Trustee is realising the goods, chattels, and effects of any estate administered by him, and such goods, chattels, and effects are not of greater value than fifty pounds, and are situated at a distance of more than ten miles from the usual place of business of a licensed auctioneer, such goods, chattels, and effects may be offered for sale by auction by some person to be appointed by the Public Trustee, and such person for the purpose of such sale shall not require to take out an auctioneer’s license.
