An Act to make the Horowhenua Lake available as a Place of Public Resort.
Preamble.
WHEREAS it is expedient that the Horowhenua Lake should be made available as a place of resort for His Majesty’s subjects of both races, in as far as it is possible to do so without unduly interfering with the fishing and other rights of the Native owners thereof:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Horowhenua Lake Act, 1905.”
2 Horowhenua Lake declared a public recreation reserve.
The Horowhenua Lake, containing nine hundred and fifty-one acres, more or less, is hereby declared to be a public recreation reserve, to be under the control of a Board, one-third at least of the members of which shall be Maoris, to be appointed by the Governor, subject to the provisions following:—
(a.)
The Native owners shall at all times have the free and unrestricted use of the lake and of their fishing rights over the lake, but so as not to interfere with the full and free use of the lake for aquatic sports and pleasures.
(b.)
No person shall be allowed to shoot or destroy birds or game of any kind on the lake or within the area of the said lake reserve.
3 Land may be acquired for boat-sheds and other buildings.
The Governor may acquire from the Native owners any area not exceeding ten acres adjacent to the lake as a site for boat-sheds and other buildings necessary to more effectually carry out the provisions of this Act.
4 Powers of Board.
The Board shall have and may exercise all the powers and functions of a Domain Board under “The Public Domains Act, 1881.”
