An Act to amend “The Factories Act, 1901.”

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title.

The Short Title of this Act is “The Factories Act Amendment Act, 1905”; and it shall form part of and be read together with “The Factories Act, 1901” (hereinafter referred to as “the principal Act”).

2 Remuneration of factory workers.

(1.)

Every person who is employed in any capacity in a factory shall be entitled to receive from the occupier payment for his work at such rate as is agreed on, being not less than

(a.)

In the case of a person under twenty years of age, a rate of five shillings per week during the first year of his employment, with an annual increase at a rate of not less than three shillings per week during every succeeding year of his employment in the same trade until he attains twenty years of age; and

(b.)

In the case of a person not under twenty years of age who has been employed in any capacity in a factory or factories for a period of not less than four years, a rate of not less than seventeen shillings per week for the first year and twenty shillings per week for the next and succeeding years.

Repeal.

(2.)

This section is in substitution for paragraph one of section thirty-one of the principal Act, which paragraph and also section three of “The Factories Amendment Act, 1902,” are hereby repealed.

3 Certificate of employment.

(1.)

The occupier shall, on the request of any person leaving employment in the factory, give to such person a certificate under his hand in the prescribed form stating correctly the period during which such person has been so employed.

(2.)

Such person shall not be entitled to demand any increased rate of payment under the last preceding section, in respect of any period of employment after the passing of this Act in any factory other than that in which he is employed, unless he produces to the occupier of the factory in which he is employed the certificate or certificates verifying such employment.

(3.)

The occupier shall keep a book in the prescribed form showing the period or periods of employment of each person employed by him, and this book shall be produced at the request of the Inspector.

(4.)

If any occupier refuses or neglects to give any such certificate on the request of any person employed by him, or gives any such certificate knowing the same to be false, or fails to keep correctly or to produce the said book, he shall be liable to a fine not exceeding twenty pounds.
