An Act to temporarily amend the Law relating to the Public Revenues.
Preamble.
WHEREAS the appropriation of the public revenues of New Zealand for the year ending the thirty-first day of March, one thousand nine hundred and seven, will not be made until the next ensuing session of Parliament, and in the meantime it is expedient to temporarily amend the law relating to such revenues so as to enable the public service to be carried on:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title. Duration of Act.
The Short Title of this Act is “The Public Revenues Acts Amendment Act, 1906”
; and it shall continue in operation until the close of the thirty-first day of August, one thousand nine hundred and six, but no longer.
2 Whilst Act in operation section 3 of “The Public Revenues Acts Amendment Act, 1896,”
extended.
Notwithstanding anything to the contrary contained in section three of “The Public Revenues Acts Amendment Act, 1896,”
or elsewhere in any Act relative to the public revenues, it is hereby declared as follows:—
(a.)
If, whilst this Act continues in operation, no Act is passed granting and appropriating money for the service of the financial year ending the thirty-first day of March, one thousand nine hundred and seven, the Colonial Treasurer may, until such Act is passed, issue and pay moneys whilst this Act continues in operation, but no longer:
Provided that payments in respect of any service shall not exceed the amount of the unexpended balance of the vote for such service provided in the Appropriation Act for the financial year immediately preceding, together with an amount bearing the same proportion to the total amount of such vote as the period elapsing between the commencement of the financial year and the close of the thirty-first day of August thereafter bears to the whole financial year:
Provided also that no payments shall be made for any services other than those for which provision was made in the Appropriation Act and the estimates for the financial year ending the thirty-first day of March, one thousand nine hundred and six, or in excess of the scale therein set forth:
Provided further that nothing herein shall affect the operation of section four of “The Public Revenues Acts Amendment Act, 1898.”
(b.)
All moneys issued and paid under the authority of this section shall be included in the estimates and accounts for the financial year ending the thirty-first day of March, one thousand nine hundred and seven.
3 Whilst Act in operation section 5 of “The Public Revenues Acts Amendment Act, 1900,”
extended.
So long as this Act continues in operation (but no longer) section five of “The Public Revenues Acts Amendment Act, 1900,”
shall be read and construed as if the words “two hundred thousand pounds”
were substituted in lieu of the words “one hundred and fifty thousand pounds.”
4 Power to transfer £300,000 from Consolidated Fund to Public Works Fund.
The Colonial Treasurer may from time to time transfer any sum or sums, not exceeding in the whole three hundred thousand pounds, from the Consolidated Fund to the Public Works Fund.
5 Certain railway increases provided for.
Whereas under Item 26 of Vote 71, Class XIX (Working Railways), in the estimates for the year ending the thirty-first day of March, one thousand nine hundred and six, provision was made, as therein mentioned, for certain increases of salaries and wages to members of the Railway Department in excess of the maximum rates of pay as set forth in the Schedules to “The Government Railways Department Classification Act, 1901”
(First and Second Divisions): And whereas, under the extended appropriation provided by section three of “The Public Revenues Acts Amendment Act, 1896,”
such increases continued to be paid after the total of the item voted had been exceeded, and by reason of the premises a technical breach of section three of “The Public Revenues Acts Amendment Act, 1900,”
has been inadvertently committed: And whereas it is expedient to validate what has been done, and to authorise the payment of such increases whilst this Act continues in operation: Be it therefore enacted that, notwithstanding anything to the contrary in section three of the last-mentioned Act, the following provisions shall have effect:—
(a.)
For the period elapsing between the first day of April, one thousand nine hundred and six, and the expiry of this Act, payments made or to be made in respect of such increases as aforesaid shall not be deemed to have been or to be invalid by reason merely that the total of the item voted is exceeded.
(b.)
For the purposes of such payments the extended appropriation provided by section three of “The Public Revenues Acts Amendment Act, 1896,”
shall be deemed to have applied until the coming into operation of this Act, and thereafter until the expiry of this Act the extended appropriation provided by section two hereof shall apply.
6 Appropriation for lauds acquired under “The Maori Land Settlement Act, 1905.”
All moneys payable in respect of the acquisition of lands under section twenty of “The Maori Land Settlement Act, 1906,”
and in respect of advances under section twenty-four thereof, shall, without further appropriation than that Act, be payable out of moneys raised under section twenty-three thereof; and that Act shall be and as from the coming into operation thereof shall be deemed to have been a sufficient appropriation accordingly.
7 Further vote for International Exhibition.
In addition to the moneys available for the purpose under the foregoing provisions of this Act, the Colonial Treasurer may from time to time, while this Act is in operation, pay out of the Consolidated Fund for the purposes of the New Zealand International Exhibition any sum or sums not exceeding in the whole the sum of fifty thousand pounds.
