An Act to prohibit the Sale of Firearms to and the Use thereof by Young Persons.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Firearms Act, 1906”
; and it shall come into operation on the first day of January, one thousand nine hundred and seven.
2 Interpretation.
In this Act, if not inconsistent with the context,—
“Firearm” means any gun or pistol of a less calibre than 303, whether acting by the force of gunpowder or not.
3 Sale of firearms, &c., to young persons prohibited.
It shall not be lawful to sell or supply firearms or any kind of ammunition for a firearm to any person under the age of sixteen years.
4 Use of firearms, &c., by young persons prohibited.
It shall not be lawful for any person under the age of sixteen years to use or carry or have in his possession any firearm or any kind of ammunition for a firearm.
5 Firearm to be forfeited.
Whenever any person under the age of sixteen years is convicted of a breach of section four of this Act, the firearm so used or carried by him or had in his possession shall be forfeited to the Crown, and may be dealt with as the Colonial Secretary shall direct.
6 Penalty.
Every person who commits a breach of this Act is liable to a fine not exceeding ten pounds.
7 Proof of age.
Where on the hearing of any proceedings the age of the person charged is not proved, the Magistrate or Justices may decide on his or their own view and judgment whether such person has attained the age of sixteen years.
8 Recovery of fines.
All fines imposed by this Act shall be recoverable in a summary way before any Magistrate or two Justices.
9 Young person not to be imprisoned.
No person under the age of sixteen years shall be liable to imprisonment in respect of any penalty imposed for a breach of section four hereof.
10 When Act not to apply.
Nothing in this Act shall apply to any person under the age of sixteen practising under proper supervision with a Morris tube or miniature rifle on a properly constructed miniature rifle range.
