An Act to make Further Provision for Customs Reciprocity between New Zealand and South Africa.
Preamble.
WHEREAS a reciprocal Customs treaty has been made between His Majesty’s Government of New Zealand and His Majesty’s Governments of the South African Colonies and Territories following—that is to say, the Colony of the Cape of Good Hope, the Colony of Natal, the Orange River Colony, the Transvaal, and Southern Rhodesia: And whereas the purport and effect of the said treaty are set out in a notice under the hand of the Minister of Customs in the Gazette of the seventh day of January, nineteen hundred and seven: And whereas in pursuance of the said treaty and in the exercise of the powers conferred by the New Zealand and South African Customs Duties Reciprocity Act, 1906, the Governor of the Colony of New Zealand did, by Order in Council dated the seventh day of January, nineteen hundred and seven, and published in the Gazette of the same day, make certain alterations therein specified of the Customs duties and exemptions in force in New Zealand, with intent thereby to fulfil the provisions of the said treaty: And whereas by virtue of the provisions of the aforesaid Act the said treaty and the said alterations of Customs duties and exemptions will shortly cease to have any force or effect: And whereas it is expedient to ratify the said treaty and to extend the term of the operation thereof:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the New Zealand and South African Customs Treaty Ratification Act, 1907.
2 Ratification and confirmation of treaty.
The said treaty is hereby ratified and confirmed, and shall continue in full force and effect until terminated by the Governor by Order in Council gazetted.
3 Ratification and confirmation of alterations in Customs duties.
The alterations in the Customs duties and exemptions so made as aforesaid by Order in Council are hereby ratified and confirmed, and shall continue to have the force of law, and all Acts relating to the Customs shall operate and be construed accordingly, until the said treaty is terminated in manner aforesaid.
4 On termination of treaty former duties to revive.
On the termination of the said treaty in manner aforesaid the Customs duties and exemptions in force immediately before the making of the said alterations therein shall revive and come into force; subject, however, to any modifications that may have been made therein by any Act to be hereafter passed.
5 Validation.
All things heretofore done in pursuance or intended pursuance of the said treaty or of the Order in Council so made as aforesaid are hereby ratified and validated.
