The Governor may from time to time, by Order in Council, authorize the holding of public exhibitions of works of industry and art within the meaning of this Act, and may set apart temporarily for the purposes of any such exhibition any area of Crown land or (with the consent of the persons in whom the fee-simple of the land is vested, or of any local body in whom the control of the land is vested) of other land.

3 Exhibition Commissioners may be appointed.

(1.)

The Governor in Council may from time to time appoint such persons as he thinks fit to be Exhibition Commissioners for the purposes of any such exhibition, and shall appoint one of those persons to be President.

Commissioners to have control of exhibition.

(2.)

Subject to the provisions of this Act, the Commissioners so appointed shall carry out and superintend the exhibition for which they are appointed Commissioners; and for that purpose shall, if the Governor in Council so directs, have exclusive control of the land set apart for the exhibition so long as may be necessary for the purposes of the exhibition.

Commission not to extend over one year unless specially authorized.

(3.)

No commission for the holding of any exhibition shall remain in force for more than one year:

Provided that the Governor in Council may in the case of any exhibition extend from time to time the time during which the commission for that exhibition shall remain in force, for such period, not exceeding one year, as he thinks fit.

4 Incorporation of Commissioners.

The Commissioners for any exhibition shall for the purposes of this Act be a body corporate by the name fixed in the Order in Council appointing the Commissioners, and shall by that name have succession until the purposes for which they were appointed have been carried out, and all claims and demands by or against them in their corporate character have been satisfied, and shall have a common seal and a right to sue or be sued, and power to compound or to prove in any Court of competent jurisdiction all debts due to them.

5 Duties of Commissioners.

Subject to any special directions by the Governor in Council, the Commissioners shall take all measures necessary for providing, erecting, altering, lighting, and maintaining the buildings and premises required for the exhibition for which they were appointed, and for providing adequate means of access thereto, and for securing and obtaining the most effective display of all articles received for public exhibition.

6 Power to close streets temporarily.

(1.)

For the purposes of any exhibition within the meaning of this Act, the Governor in Council may from time to time authorize the Commissioners to temporarily close any road or street, or any part thereof, and to enter into occupation of the same, and construct any building or erect any fence thereon, and dig up and remove the soil thereof, and otherwise make use of the road or street, or part thereof, closed as aforesaid, as if the same were land granted for the purpose.

(2.)

No Order shall be made under this section by the Governor in Council unless he is satisfied that the local authority and the owners of the property adjoining the road or street proposed to be closed consent thereto.

(3.)

The Commissioners shall as soon as practicable after the close of the exhibition, and on the request of the local authority having the control of the road or street closed as aforesaid, remove all buildings, fences, and other obstructions on the said road or street, and restore the soil thereof and the level thereof to the same condition as when they entered into occupation thereof.

7 Power to make by-laws.

The Commissioners may from time to time, with the approval of the Governor in Council, make such by-laws as they think fit for any of the following purposes:—

(a.)

The conduct of their own proceedings;

(b.)

The due management of the affairs of the exhibition in its several departments;

(c.)

The temporary admission or exclusion of the public or any individual to or from the exhibition buildings or grounds or any part thereof respectively, and the behaviour to be observed therein;

(d.)

The sum to be demanded and paid for admission to the exhibition buildings or grounds or any part thereof respectively, and, subject to the provisions of paragraph (b) of section eleven hereof, the manner in which all moneys received by the Commissioners shall be applied; and

(e.)

Any purposes of public instruction, enjoyment, or entertainment for which the exhibition buildings or grounds or any part thereof respectively may be used and applied:

Provided that no Commissioners appointed under this Act shall permit any person or persons to sell intoxicating liquors within the precincts of any area under their control.

8 Exemption of exhibits from Customs duties.

(1.)

The Governor may, by Order in Council, remit or reduce, as he thinks fit, the duties of Customs or excise payable in respect of goods for the purpose of any exhibition named in the Order.

(2.)

The Governor may also, by Order in Council, modify, suspend, or alter the provisions of the Customs Law Act, 1908, the Beer Duty Act, 1908, or any other Act relating to Customs or excise, with respect to goods for any exhibition specified in the Order.

9 Governor may suspend, &o., certain Acts.

(1.)

The Governor in Council may from time to time suspend, modify, or negative, either absolutely or subject to such conditions as he thinks fit,—

(a.)

All or any of the provisions of the Industrial Conciliation and Arbitration Act, 1908, and of any award or industrial agreement in force thereunder, and of the Factories Act, 1908, and the Shops and Offices Act, 1908, in the case of any exhibition mentioned in the Order, either generally or so far as they affect the Commissioners, or any person employed by them, or any exhibitor, or any person employed in or about the exhibition:

(b.)

All or any of the provisions of the Immigration Restriction Act, 1908, in the case of persons who desire to enter New Zealand as visitors or exhibitors in connection with the exhibition.

(2.)

Nothing in this section shall authorize the working by any person of a greater number of hours in any day or in any week, nor the payment to any person of a lower rate of wages, than is provided for ordinary work or for overtime under any Act, or any award or industrial agreement under the Industrial Conciliation and Arbitration Act, 1908.

10 Inspection of machinery used at exhibitions.

The provisions of the Inspection of Machinery Act, 1908, relating to the inspection of machinery and boilers, and to the fencing of machinery, and to defective machinery, shall apply to boilers and machinery used at or in connection with any exhibition: Provided that no fee shall be charged for any inspection under this section of any boiler or machinery used solely for driving purposes at or in connection with the exhibition.

11 Provisions as to Government exhibitions.

Where the expenses of carrying out any exhibition are defrayed wholly or in part out of moneys provided by Parliament, the following provisions shall apply:—

(a.)

All moneys from time to time appropriated by Parliament for the purposes of the exhibition, and all moneys received by the Commissioners in respect of the exhibition, shall be paid into the bank at which the Public Account is kept, to the credit of an account to be called “The Exhibition Account.”

(b.)

The moneys from time to time standing to the credit of the last-mentioned account shall from time to time be applied to the purposes of the exhibition by the Commissioners under the direction of the Minister of Internal Affairs.

Parliament.

(c.)

Not later than three months after the close of the exhibition, and again not later than three months after the affairs of the exhibition have been finally wound up and all claims and demands by and against the Commissioners have been satisfied, the Commissioners shall transmit to the Minister of Internal Affairs a report of their proceedings, containing a full account of their receipts and expenditure, duly audited by the Audit Office; and a copy of each such report, and of all regulations and by-laws made in connection with the exhibition, shall be laid before Parliament.

(d.)

If on the final winding-up of the affairs of any such exhibition the Audit Office reports that there are any surplus proceeds from any source whatever, the amount of such surplus proceeds shall be paid by the Commissioners into the Public Account.

12 Local authorities may exhibit.

(1.)

Any local authority may, out of its ordinary revenue, defray the cost of collecting and preparing exhibits of the products and resources of its district, and of exhibiting the same at any exhibition within the meaning of this Act.

(2.)

For the purposes of this section “local authority” means the Council of any borough or county, or any Road Board, Town Board, or Education Board.

13 Repeals.

The New Zealand International Exhibition Empowering Act, 1905, and the New Zealand International Exhibition Act, 1906, are hereby repealed.

14 Application of Act.

This Act shall apply only to such exhibitions as are declared by the Governor in Council to be exhibitions within the meaning of this Act.
