An Act to amend the Government Railways Act, 1908.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
(1.)
This Act may be cited as the Government Railways Amendment Act, 1912, and shall form part of and be read together with the Government Railways Act, 1908 (hereinafter referred to as the principal Act).
Commencement.
(2.)
This Act shall come into operation on the first day of April, nineteen hundred and thirteen.
2 Repeals.
(1.)
The Third Schedule to the principal Act and the Schedule to the Government Railways Amendment Act, 1911, are hereby repealed, and the Schedule hereto substituted in lieu thereof.
(2.)
Section five of the Government Railways Amendment Act, 1910, and section two of the Government Railways Amendment Act, 1911, are hereby repealed.
3 All members to be classified as specified in Schedule.
(1.)
For the purposes of this Act the Minister, on the first day of April, nineteen hundred and thirteen, shall cause all members then in the service of the Department to be classified according to the classification set forth in the Schedule hereto, and shall fix each member’s rate of pay and the date on which his first annual increment (if provided by the said Schedule) begins to be payable:
Provided that in no case shall such increment begin earlier than twelve months after the date on which his last previous increment began to be payable:
Provided also that with respect to every member the right to advance from one subgrade to another or, where there are no subgrades, the right to receive any increase of pay shall in each case depend upon the efficiency and good conduct of that member, and no such advancement shall be made or increase payable unless the permanent head of the Department certifies in writing that the member is entitled thereto.
Annual list to be laid before Parliament.
(2.)
From such classification there shall be prepared and laid before Parliament each year a list setting out in order of classification the names, status, and pay of each member, and the number of years he has been in the service of the Department.
Repeal.
(3.)
Section fifty of the principal Act is hereby repealed.
4 Section 63 of principal Act amended.
Section sixty-three of the principal Act is hereby amended by repealing paragraph (c), and substituting the following in lieu thereof:—
“(c.)
No solicitor, counsel, or agent (other than a member of the Department or the secretary of any society of members of the Department recognized by the Minister for the purposes of this section) shall appear to be heard on any appeal; but the appellant shall appear in person, or by another member, or by the secretary of any such society aforesaid, and the Department shall appear by some member appointed by the Minister in that behalf.”

Engineering (civil, mechanical, and drafting) cadets shall be entitled to receive £10 per annum in addition to the rates specified in Grade 11, and on completion of their cadetship shall start in the 10th grade at £135.
Members of the 11th grade living away from their homes when on duty shall be paid 10s. a week lodging-allowance while in subgrade 1, 8s. a week in subgrade 2, and 5s. a week in subgrade 3.
Members of the 11th grade (other than engineering cadets) who pass the Matriculation Examination or who pass the Junior Civil Service Examination with credit shall be entitled to count six months’ service therefor, and for passing the Senior Civil Service Examination they shall be entitled to count twelve months service.
Members of the 11th grade (other than engineering cadets) who are certified by competent teachers as able to write one hundred words per minute in shorthand and to type forty words per minute on the typewriter shall be entitled to count six months’ service for such certificate if in the case of youths who have passed the Senior Civil Service Examination shorthand was not one of the subjects taken to enable them to pass.
