An Act to suspend certain Provisions of the Legislature Act, 1908, relating to the Disqualification of Members of the Legislative Council and of the House of Representatives.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Suspension of Disqualification During War Act, 1915, and shall form part of and be read together with the Legislature Act, 1908.

2 Members of Parliament not disqualified by reason of appointment to or enlistment in His Majesty’s Naval or Military Forces.

(1.)

Notwithstanding anything to the contrary in the Legislature Act, 1908, the seat of a member of the Legislative Council or of the House of Representatives shall not become vacant, nor shall any person be incapable of appointment to the Legislative Council or of election to the House of Representatives, by reason—

(a.)

Of his enlistment in any of His Majesty’s Military or Naval Forces raised for service beyond New Zealand; or

(b.)

Of his appointment as a commissioned or non-commissioned officer in either of the said Forces; or

(c.)

Of his receipt of pay in either of the said Forces.

(2.)

No person who enlists in or is appointed as a commissioned or non-commissioned officer in either of the said Forces while he is or within twelve months after he has ceased to be a member of the Legislative Council or of the House of Representatives shall thereby be deemed to be a Civil servant or contractor, notwithstanding the receipt by him of pay in respect of such enlistment or appointment.

3 Commencement of Act.

This Act shall be deemed to have been in force since the fourth day of August, nineteen hundred and fourteen.
