An Act to amend the Legislative Council Act, 1914.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Legislative Council Amendment Act, 1918, and shall be read together with and deemed part of the Legislative Council Act, 1914 (hereinafter referred to as the said Act).
2 Repeals.
(1.)
Subsections two and three of section one of the said Act are hereby repealed.
(2.)
Section twenty-three of the said Act is hereby repealed.
Duration of appointments to Council.
(3.)
Every person who before the passing of this Act has been duly appointed to be and is now a member of the Council, and every person who shall hereafter be so appointed, shall hold his seat therein for seven years to be reckoned from the date of the instrument of his appointment and no longer; but every such person may from time to time before the commencement of the said Act be reappointed.
(4.)
Nothing in this section shall be deemed to repeal or in any manner affect the provisions of subsection two of section three of the Legislature Act, 1908, or of sections four and five of that Act.
(5.)
This section shall come into force at the date of the passing of this Act.
3 Dates of first and subsequent elections of Councillors.
(1.)
Section twelve of the said Act is hereby amended by repealing all words thereof exclusive of the proviso, and substituting the following words: “The first election of members of the Council shall take place simultaneously with the first election of members of the House held after the commencement of this Act; and, except as provided by this section, the next and every succeeding election of members of the Council shall take place simultaneously with the election of members of the House held next after the expiration of five years from the last preceding election of members of the Council.”
4 Date of commencement of Legislative Council Act, 1914.
(1.)
Except as provided by sections two and five of this Act, the said Act shall commence on a date to be appointed for the commencement thereof by Proclamation.
(2.)
The date so appointed shall not be within the period of twelve calendar months ensuing immediately after the publication of such Proclamation in the Gazette.
5 Repeals.
(1.)
Subsections two and three of section thirteen of the said Act are hereby repealed, and the following subsections substituted in lieu thereof:—
Division of New Zealand into electoral divisions.
“(2.)
The said electoral divisions shall, until altered by the Representation Commissions as provided by this Act, be such as shall be defined by Order in Council published in the Gazette.
“(3.)
Such definition of the electoral divisions shall be determined in accordance with the Rules (a) to (f) inclusive specified in section sixteen hereof, the words ‘the Governor-General in Council’ being for this purpose substituted for the words ‘the Commissions’ in Rule (c).”
Repeal.
(2.)
The First Schedule to the said Act is hereby repealed.
Commencement of section.
(3.)
This section shall come into force on the day of the publication in the Gazette of the Proclamation referred to in section four hereof.
6 Section 15 of Legislative Council Act, 1914, amended.
Section fifteen of the said Act is hereby amended by inserting, after the word “whenever,”
the words “after the commencement of this Act.”
7 Repeal.
The Legislative Council Amendment Act, 1916, is hereby repealed.
