An Act to amend the Kauri-gum Industry Act, 1908
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Kauri-gum Industry Amendment Act, 1919, and shall be read together with and deemed part of the Kauri-gum Industry Act, 1908 (hereinafter referred to as the principal Act).
2 Section 3 of Amendment Act, 1915 (relating to leases of lands specially set apart for kauri-gumdigging purposes), amended.
(1.)
A lease granted under section three of the Kauri-gum Industry Amendment Act, 1915, may be for a term not exceeding twenty-one years, or may be for a term not exceeding twenty-one years with a right of renewal for one or more terms, but so that the aggregate duration of the original and the renewed terms shall not exceed forty-two years.
(2.)
Section three of the Kauri-gum Industry Amendment Act, 1915, is hereby amended by omitting from the proviso to subsection two the words “and no lease shall be for a longer term than twenty-one years.”
3 Provision for issue of gum-brokers’ licenses.
(1.)
In addition to the classes of licenses provided for by the principal Act there may be issued under that Act a kauri-gum-broker’s license (hereinafter referred to as a gum-broker’s license).
(2.)
A gum-broker’s license shall authorize the holder thereof, acting as the agent of the purchaser or the seller or of both, to buy and sell kauri-gum.
(3.)
Every person commits an offence against the principal Act, and shall be liable accordingly, who, not being the holder of a gum buyer’s license or of a gum-broker’s license, buys or sells kauri-gum as agent either of the seller or of the purchaser.
4 License fees payable under principal Act.
(1.)
There shall be payable upon the issue of licenses under the principal Act, and upon every annual renewal thereof, license fees at the rates hereinafter specified, that is to say,—
(a.)
In respect of every special license, a fee of five shillings;
(b)
In respect of every ordinary license, a fee of five pounds;
(c.)
In respect of every gum-buyer’s license, a fee of one pound; and
(d.)
In respect of every gum-broker’s license, a fee of five pounds.
Repeals.
(2.)
This section is in substitution for paragraph (c) of section nine of the principal Act, and that paragraph is hereby accordingly repealed.
(3.)
The Schedule to the Kauri-gum Industry Amendment Act, 1910, is hereby amended by repealing so much thereof as amends paragraph (c) of section nine of the principal Act.
5 Section 14 of principal Act (relating to holders of gum-buyers’ licenses) extended to apply to gum-brokers.
Section fourteen of the principal Act is hereby amended by omitting the words “With respect to gum-buyers’ licenses and the holders thereof,”
and substituting the words “With respect to gumbuyers’ licenses and gum-brokers’ licenses and the holders thereof respectively.”
6 Section 4 of Amendment Act, 1915 (relating to offence of lighting fires on landsin kauri-gum districts), extended.
Section four of the Kauri-gum Industry Amendment Act, 1915, is hereby amended by omitting from subsection two the words “special or of an ordinary license or of a gum-buyer’s license,”
and substituting the words “license of any description.”
