An Act to amend the Tramways Act, 1908.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Tramways Amendment Act, 1920, and shall be read together with and deemed part of the Tramways Act, 1908 (hereinafter referred to as the principal Act).
2 Definition of “railway”
in section 209 of Public Works Act, 1908, amended so a to include a private tramway.
Section two hundred and nine of the Public Works Act, 1908, is hereby amended by omitting the definition of “railway,”
and substituting the following definition:—
“‘Railway’ means and includes all railways (other than railways for the time being vested in His Majesty) and all tramways, whether constructed under the authority of this or any other Act or not.”
3 Regulations for securing the safety of passengers and others.
(1.)
The Governor-General may from time to time, by Order in Council, make such regulations as he thinks fit with respect to public or private tramways for securing the safety of passengers, of tramway employees, and of the general public.
(2.)
Such regulations may apply generally to all tramways, or to any specified class or classes of tramways, and, notwithstanding anything to the contrary in the principal Act or any instrument thereunder or in any other Act, shall apply as well to tramways laid out or constructed before the passing of this Act as to tramways laid out or constructed after that date.
(3.)
The power conferred by this section is in addition to, and not in substitution for, any power to make regulations with respect to the safety of any persons conferred on the Governor-General by the principal Act.
