An Act to amend the Surveyors’ Institute and Board of Examiners Act, 1908.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Surveyors’ Institute and Board of Examiners Amendment Act, 1922, and shall be read together with and deemed part of the Surveyors’ Institute and Board of Examiners Act, 1908 (hereinafter referred to as the principal Act).
2 Surveyor-General to be Chairman of Surveyors’ Board.
Section eleven of the principal Act is hereby amended by inserting in paragraph (b), after the words “a member of the Board,”
the words “and the Chairman thereof.”
3 Procedure at meetings of Board.
Section twelve of the principal Act is hereby amended by adding the following subsections: —
“(3.)
In the absence of the Chairman from any meeting of the Board the members present shall appoint one of their number to act as chairman at that meeting, and the member so appointed shall have the same powers at that meeting as if he were the Chairman of the Board.
“(4.)
The Chairman shall have a deliberative vote, and, in case of an equality of votes, shall also have a casting-vote.”
4 Section 17 of principal Act amended.
(1.)
Subsection one of section seventeen of the principal Act is hereby amended by omitting paragraph (f), and substituting the following:—
“(f.)
The conduct of surveys, and for ensuring the accuracy of plans and surveys required under any Act relating to or affecting surveys of land, except surveys carried out by or under the direction of the Surveyor-General.”
(2.)
No regulations shall be made by the Board for the purposes mentioned in paragraph (f) of the said section seventeen, as amended by this section, save at a meeting at which the Surveyor-General is present.
5 Rules to be made by Survey or-General.
(1.)
The Surveyor-General may from time to time make rules for all or any of the following purposes:—
(a.)
The conduct and control of fundamental or basic surveys to be made for standard, topographical, geodesical, or other scientific purposes:
(b.)
The conduct and control of the technical operations carried out by the Department of Lands and Survey:
(c.)
Prescribing the fees to be paid for the inspection, or examination, or checking of plans, and also prescribing rates of payment for surveys executed under the direction of the Crown.
(2.)
The provisions of subsection two of section seventeen of the principal Act shall apply to rules made pursuant to this section, in the same manner as to regulations made by the Board.
6 Fees.
The Second Schedule to the principal Act is hereby repealed, and the Schedule to this Act substituted therefor.
7 Repeals.
(1.)
Paragraph (b) of subsection one of section three of the Land Act, 1908, and subsection one of section one hundred and seventy-seven of the Land Transfer Act, 1915, are hereby repealed.
Saving of existing regulations.
(2.)
All regulations made under either of the enactments repealed by the last preceding subsection, and in force on the coming into operation of this Act, shall enure for the purposes of the principal Act, as amended by this Act, as fully and effectually as if they had originated under that Act, and accordingly shall, where necessary, be deemed to have so originated.
