An Act to amend the Auckland University College Act, 1882.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Auckland University College Amendment Act, 1923, and shall be read together with and deemed part of the Auckland University College Act, 1882 (hereinafter referred to as the principal Act).
2 President of the College.
(1.)
There shall be a President of the College.
(2.)
The person holding the office of Chairman of the Council at the passing of this Act shall be deemed to have been duly elected as President of the College, and shall hold office as President for the remainder of the term for which he was elected Chairman or until the election of his successor (whichever period is the longer).
(3.)
The office of the Chairman of the Council under the principal Act is hereby abolished.
(4.)
All references in the principal Act and in any other enactment to the Chairman of the Council shall be read as references to the President of the College.
3 Principal of the College.
(1.)
The Council may from time to time appoint a member of the Professorial Board or some other person to be the Principal of the College. Every person so appointed shall hold office during the pleasure of the Council, and if not otherwise a member of the Professorial Board shall be a member thereof by virtue of his office.
(2.)
The Principal—
(a.)
Shall be the academic head of the College and Chairman of the Professorial Board:
(b.)
May, during the intervals between meetings of the Professorial Board, exercise alone (but subject always to the control of the Council) the powers of the Board as to regulating the admission of students and maintaining the ordinary discipline of the College, and suspend any student guilty of any breach of discipline:
(c.)
May suspend the operation of any regulation made by, or any resolution of, the Professorial Board until the same shall have been approved by the Council.
(3.)
Section twenty-one of the principal Act is hereby consequentially amended by omitting the words “The Professorial Board shall elect one of themselves to be Chairman of the Board, to hold office for one year.”
4 Principal to be ex officio member of Council.
(1.)
The Principal of the College shall by virtue of his office be a member of the Council; and notwithstanding anything to the contrary in section two of the Auckland University College Amendment Act, 1912, the Professorial Board shall, while any person holds the office of Principal of the College, appoint only one member of the Council.
(2.)
In the event of the Principal of the College being appointed when there are already two other persons in office as members of the Council appointed by the Professorial Board, one of such members, to be decided by lot, shall retire from membership of the Council on the first day of the month following that in which the Principal was appointed, and the Principal shall take office as a member of the Council on that day.
