An Act to amend the Industrial Societies Act, 1908.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Industrial Societies Amendment Act, 1926, and shall be read together with and deemed part of the Industrial Societies Act, 1908 (hereinafter referred to as the principal Act).
2 Change of name of incorporated society.
(1.)
The Governor-General may, by Order in Council, change the name of any society incorporated under the principal Act on receipt of a certified copy of a resolution requesting him so to do passed at a general meeting of the society.
(2.)
Such alteration of name shall not affect any rights or obligations of the society or of any member thereof.
3 Dissolution of society.
(1.)
If at any time the Governor-General is satisfied that a society incorporated under the principal Act is no longer carrying on its operations, or has been incorporated by reason of a mistake of fact or law, or if a petition based upon a resolution requesting him so to do passed at a general meeting of the society is presented to him, the Governor-General may, by Order in Council, dissolve the society as from a date mentioned in such Order, and every such Order shall have effect according to its tenor.
(2.)
On the dissolution of a society pursuant to the last preceding subsection all surplus assets, after the payment of all costs, debts, and liabilities, shall be disposed of in such manner as the society may have determined prior to its dissolution by resolution passed at a general meeting thereof, or, in default of such determination, in manner appointed by the Governor-General in Council.
4 Section 12 of principal Act amended.
Section twelve of the principal Act is hereby amended by omitting from subparagraph (iv) of paragraph (s.) the words “Minister of Internal Affairs,”
and substituting the words “Minister of Industries and Commerce.”
