An Act to amend the Kauri-gum Industry Act, 1908.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Kauri-gum Industry Amendment Act, 1927, and shall be read together with and deemed part of the Kauri-gum Industry Act, 1908 (hereinafter referred to as the principal Act).
2 No person qualified to be the holder of a gum-broker’s license and also of a gum-buyer’s license.
(1)
Except as provided in the next succeeding subsection no person shall, after the commencement of this Act, be qualified to be the holder of a kauri-gum broker’s license while he is the holder of a kauri-gum buyer’s license.
(2)
If any person is at the commencement of this Act the holder of a kauri-gum broker’s license and also of a kauri-gum buyer’s license, such licenses may continue in force, unless sooner revoked or forfeited pursuant to the provisions of the principal Act in that behalf, until the expiry of the period for which they were granted or last renewed, as the case may be.
3 Issue of licenses under principal Act.
(1)
Every special or ordinary kauri-gum-digging license under the principal Act that may be issued or renewed after the commencement of this Act shall be so issued or renewed by the Commissioner of Crown Lands for the land district within which the license is to apply.
(2)
Every kauri-gum buyer’s license and every kauri-gum broker’s license under the principal Act that may be issued or renewed after the commencement of this Act shall be so issued or renewed by the Kauri-gum Control Board established under the Kauri-gum Control Act, 1925.
Repeal.
(3)
Section three of the Kauri-gum Industry Amendment Act, 1910, is hereby repealed.
4 Mode of effecting renewal of licenses under principal Act.
(1)
The renewal of any license under the principal Act may be effected by the endorsement thereon of a statement to the effect that the license has been renewed for the period therein mentioned and that the renewal fee has been paid. In the case of licenses issued or renewed by the Commissioner of Crown Lands every such endorsement shall be signed by him or by some person on his behalf, and in all other cases shall be signed by the Chairman or the Secretary of the Kauri-gum Control Board.
Consequential amendments of principal Act.
(2)
Paragraph (d) of section nine of the principal Act, with so much of the Schedule to the Kauri-gum Industry Amendment Act, 1910, as relates to the said paragraph, is hereby repealed.
(3)
Paragraph (e) of the said section nine, as amended by the Kauri-gum Industry Amendment Act, 1910, is hereby further amended by inserting, after the word “Commissioner,”
the words “or other appropriate authority.”
5 Registers to be kept of licenses issued under principal Act.
(1)
The name of the register to be kept by the Commissioner pursuant to section thirteen of the principal Act is hereby altered to “The Kauri-gum-digging License Register,”
and the said section is hereby amended accordingly.
(2)
The Kauri-gum Control Board shall keep a register of all kauri-gum buyers’ licenses issued or renewed by it, and another register of all kauri-gum brokers’ licenses issued or renewed by it. The provisions of section thirteen of the principal Act as to registers shall apply, with the necessary modifications, to the registers to be kept pursuant to this subsection.
6 Consequential amendment of section 26 of principal Act.
Section twenty-six of the principal Act, as amended by the Kauri-gum Industry Amendment Act, 1910, is hereby further amended by inserting, after the word “Commissioner”
in paragraph (a), the words “or other authority by which the license was issued or last renewed, as the case may be”
; and by inserting, after the word “Commissioner”
in paragraph (b), the words “or other authority as aforesaid.”
7 Section 4 of Amendment Act, 1910, amended.
Section four of the Kauri-gum Industry Amendment Act, 1910, is hereby amended by omitting the words “or, in the absence of such prescription, as may be fixed in each case by the Commissioner.”
8 Repeal.
Section twenty-nine of the principal Act is hereby repealed.
