Contents
An Act to alter the Name of the New Zealand College of Agriculture and to make other Provisions with respect thereto.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Massey Agricultural College Act, 1927, and shall be read together with and deemed part of the Act heretofore known as the New Zealand Agricultural College Act, 1926 (hereinafter referred to as the principal Act).
2 Altering title of principal Act, and altering name of College established thereunder.
(1)
The principal Act may hereafter be cited as the Massey Agricultural College Act, 1926; and the College established thereunder shall hereafter be known as the Massey Agricultural College.
(2)
The principal Act is hereby consequentially amended by substituting the name “Massey”
for the words “New Zealand”
wherever reference is made to the title of the Act, or to the name of the College, or to the name of the Council.
3 Attendance at Massey Agricultural College to be equivalent to attendance either at Victoria University College or at Auckland University College.
For the purpose of complying with the requirements of any Act, or of the University of New Zealand, with respect to the entry of the name of any person on the books of a University College or the attendance of any student at a University College, or the doing of any work, or the keeping of terms, or with respect to any other matter relative to the grant of a degree by the Council of the University of New Zealand, the Massey Agricultural College shall be deemed part of the Victoria University College or of the Auckland University College, as the circumstances of any case may require.
4 Council may grant diplomas in agricultural science.
The Council of the College established under the principal Act shall, without reference to the Council of the University of New Zealand or to the Council of the Victoria University College or the Auckland University College, have power to grant diplomas in agricultural science, and may, by by-laws made under section thirteen of the principal Act, prescribe the fees to be payable to the Council in respect of any such diploma.
5 Moneys raised under Education Purposes Loans Act to be available for equipment of College.
(1)
Any moneys for the time being in the Education Loans Account established under the Education Purposes Loans Act, 1919, may, without further appropriation than this Act, be applied as if the College established under the principal Act were an institution affiliated to the University of New Zealand.
(2)
In addition to the purposes specified in the Schedule to the Education Purposes Loans Act, 1919, in their application to the College established under the principal Act, moneys may, without further appropriation than this Act, be expended out of the Education Loans Account in the purchase of any live-stock, implements, or material required for the purposes of the College.
(3)
Section sixteen of the Appropriation Act, 1926, is hereby repealed.
6 Control of property held for purposes of College.
(1)
The Governor-General may by Order in Council transfer to the Council of the College the control and management of any land that has heretofore been or that may hereafter be acquired by the Crown for the purposes of the College out of moneys in the Education Loans Account, or otherwise howsoever.
(2)
Any Order in Council under this section may in like manner be at any time amended or revoked.
(3)
All live-stock, implements, and material acquired by the Crown for the purposes of the College out of moneys in the Education Loans Account, or otherwise howsoever, shall, on being handed over to the Council, become the property of the College.
7 Property may be vested in corporation of College.
The Governor-General may at any time, by Warrant under his hand, authorize the issue of a certificate of title, in favour of the corporation of the College, in respect of any land held by the Crown for the purposes of the College; and all land vested in the said corporation pursuant to this section shall be held in trust for the purposes of the College.
8 Section 22 of principal Act (relating to payment of subsidies on voluntary contributions) amended.
(1)
Notwithstanding anything to the contrary in section twenty-two of the principal Act, the total amount of subsidy payable in respect of any voluntary contribution received by the Council, whether before or after the passing of this Act, shall not exceed the sum of twenty-five thousand pounds.
(2)
The said section twenty-two is hereby amended by omitting the reference to the Minister of Education in subsections three and five and in each case substituting a reference to the Minister of Agriculture.
(3)
Section twenty-four of the principal Act is hereby amended by inserting, after the word “Minister,”
the words “of Agriculture.”
9 Staff of College to become contributors to Teachers’ Superannuation Fund.
(1)
For the purposes of the Teachers’ Superannuation Fund the definition of the term “Education service,”
as used in Part I of the Public Service Classification and Superannuation Amendment Act, 1908, is hereby extended to include service under the Council of the College established under the principal Act, and every person who is first permanently employed in the service of the Council shall thereupon become a contributor to that fund unless he is already a contributor thereto.
(2)
This section shall be deemed to have been in force as from the commencement of the principal Act.
