An Act to amend the Stock Act, 1908.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Stock Amendment Act, 1930, and shall be read together with and deemed part of the Stock Act, 1908 (hereinafter referred to as the principal Act).
2 Stock to be moved only in daytime.
(1)
Except as provided in the next succeeding subsection, every person who drives, leads, or conveys any stock on, along, or across any highway or Crown lands, or who conveys any stock on any river, lake, harbour, or other waters within the territorial limits of New Zealand, during the period between half an hour after sunset and half an hour before sunrise, unless provided with a permit so to do from a Justice, or an auctioneer, Postmaster, or constable, or an Inspector under the principal Act or the Slaughtering and Inspection Act, 1908, commits an offence, and is liable in respect of every such offence to a fine not exceeding fifty pounds.
Exceptions.
(2)
The last preceding subsection shall not apply—
(a)
To the owner of any stock, or his servant or agent, driving, leading, or conveying such stock within the limits of any land in his lawful occupation or from any such land to any other land in his lawful occupation distant not more than six miles from such land:
(b)
To any person driving, leading, or conveying any stock within the limits of any borough at any hour in accordance with any by-law in force in such borough:
(c)
To the owner of any stock, or his servant or agent, driving or leading such stock to or from any public saleyard not more than six miles from his homestead:
(d)
To any person leading, driving, or riding a horse or horses in harness or saddle, or driving cattle in harness:
(e)
To any person in the employment of the Government Railways Department driving, leading, or conveying any stock in the course of such employment:
(f)
To the owner or master of any vessel, or any other person, in respect of the carriage of any stock under a bill of lading or other shipping document.
Repeal
(3)
This section is in substitution for section fifty-eight of the principal Act, and that section is hereby accordingly repealed.
3 Section 64 of principal Act amended.
Section sixty-four of the principal Act is hereby amended by omitting from paragraph (b) the words “any Registrar”
, and substituting the words “any fit person”
.
