Contents
An Act to amend the Opticians Act, 1928.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Opticians Amendment Act, 1934, and shall be read together with and deemed part of the Opticians Act, 1928 (hereinafter referred to as the principal Act).
2 Extension of provisions for registration of persons who were practising as opticians on passing of principal Act
(1)
Notwithstanding the provisions of subsection two of section six of the principal Act, application for registration as an optician under paragraph (a) of subsection one of that section may be made to the Board at any time within one year after the passing of this Act.
(2)
On receipt of, any application under the last preceding subsection, the Board shall cause the application to be referred to a Stipendiary Magistrate to determine whether or not there was any good and sufficient reason why the applicant failed to make application within the time limited by subsection two of section six of the principal Act.
(3)
If in any such case the Magistrate is of opinion that the applicant had a good and sufficient reason for failing to make application within the time required by the principal Act, he shall so report to the Board, and thereupon the Board shall deal with the application as if it had been duly made within the time limited by the principal Act in that behalf.
3 Opticians to send notice of change of address, and register to be amended accordingly.
(1)
Every registered optician who at any time changes his address as appearing on the register shall, within three months thereafter, send to the Registrar a notice of his new address, and the Registrar shall thereupon correct the entry in the register relating to that person accordingly.
(2)
Every registered optician who fails to comply with the provisions of the last preceding subsection shall be liable to a fine not exceeding one pound.
4 Name may be erased from register if registered person cannot be found, &c.
(1)
The Registrar may at any time and shall if the Board so directs send to any registered optician, by registered letter addressed to him at his address as appearing on the register, an inquiry as to whether or not he desires to have his name retained on the register or has ceased to practise.
(2)
If no reply is received to that letter within three months from the posting thereof, or if the letter is not delivered and is returned to the Registrar, the Registrar shall, if the Board so directs, remove from the register the name of the optician to whom the letter was so sent.
(3)
Any person whose name has been removed from the register in pursuance of this section may apply to the Registrar to have his name restored to the register, and the Registrar shall thereupon restore to the register the name of that optician.
5 Power to make regulations controlling advertising by registered opticians.
The authority to make regulations conferred on the Governor-General by section twenty-one of the principal Act is hereby extended to enable him, on the recommendation of the Board, to make regulations for the control of advertisements relating to the practice of qualifications of any registered opticians, or of any class of registered opticians, and prescribing fines, not exceeding twenty pounds in any case, for offences against such regulations.
