This Act may be cited as the Rabbit Nuisance Amendment Act, 1935, and shall be read together with and deemed part of the Rabbit Nuisance Act, 1928 (hereinafter referred to as the principal Act).

A Rabbit Board established under the principal Act shall have power to purchase and to sell or otherwise dispose of goods or substances intended to be used for the destruction of rabbits or for the prevention of the incursion or increase of rabbits within its district.

Without limiting in any way the general powers conferred on it by the provisions of the last preceding subsection a Rabbit Board may, for the purpose of exercising such powers, apply for and be granted a license under the Poisons Act, 1934, to sell poison, or a license under the Arms Act, 1920, to deal in ammunition, notwithstanding anything to the contrary in either of those Acts.

For the purposes of the Poisons Act, 1934, a sale by a Rabbit Board to any person of any poison intended to be used for the destruction of rabbits or for the prevention of the incursion or increase of rabbits within its district shall be deemed to be a sale by wholesale.

No license under the Poisons Act, 1934, shall be granted to a Rabbit Board to sell poisons other than poisons for the time being included in the Third Schedule to the said Act.

Where any purchase, sale, or other disposition of poison or ammunition has been made by a Rabbit Board before the passing of this Act, such purchase, sale, or disposition shall be deemed to have been lawfully made.
