BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
1934, No. 34
This Act may be cited as the Agriculture (Emergency Powers) Amendment Act, 1936, and shall be read together with and deemed part of the Agriculture (Emergency Powers) Act, 1934 (hereinafter referred to as the principal Act).
2 Regulations under principal Act may impose obligations on manufacturers of containers of dairy-produce.
While regulations under the Dairy Industry Act, 1908, or any other Act, are in force requiring any dairy-produce to be packed in containers of a prescribed kind, regulations may be made under the principal Act to ensure that manufacturers or other suppliers of containers for such dairy-produce shall supply containers of the prescribed kind, anything to the contrary notwithstanding in any contract entered into by a manufacturer with the user of such containers or with any other person.
3 Penalty for offences against regulations made under authority of principal Act.
(1)
Every person who commits, or attempts to commit, or does any act with intent to commit, an offence against any regulations made under the principal Act (whether such regulations have been made before or are made after the passing of this Act, and notwithstanding anything to the contrary in such regulations) shall be liable on summary conviction to a fine of two hundred pounds, in the case of an individual, and, in the case of a company or other corporation, to a fine of one thousand pounds.
(2)
Any proceedings for an offence against any such regulations may be commenced at any time within three years after the commission of the offence.
