Pursuant to section 62B(4) of the District Courts Act 1947, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.
Order
1 Title
This order is the District Courts (Prescribed Rate of Interest) Order 2011.
2 Commencement
This order comes into force on 1 July 2011.
3 Application
This order applies to every judgment given on or after 1 July 2011 in proceedings of a kind described in section 62B(1) or (3) of the District Courts Act 1947 (whether the proceedings were commenced before, on, or after that day).
4 Rate of interest of 5.0% prescribed
This clause prescribes for the purposes of section 62B of the District Courts Act 1947 the rate of 5.0% per year.
5 Revocation
The District Courts (Prescribed Rate of Interest) Order 2008 (SR 2008/144) is revoked.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 1 July 2011, decreases from 8.4% to 5.0% the maximum rate of interest that a District Court can, under section 62B(1) or (3) of the District Courts Act 1947, include in the sum for which judgment is given in proceedings for the recovery of a debt or damages.
This rate will also apply under section 65A of that Act (which relates to interest on judgment debts).

1 General
This is a consolidation of the District Courts (Prescribed Rate of Interest) Order 2011 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
Section 78 of the Legislation Act 2019 provides that this consolidation, published as an electronic version, is an official version. A printed version of legislation that is produced directly from this official electronic version is also an official version.
