An Act to Amend the Veterinary Services Act, 1946.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Veterinary Services Amendment Act, 1948, and shall be read together with and deemed part of the Veterinary Services Act, 1946 (hereinafter referred to as the principal Act).

2 Altering constitution of Veterinary Services Council.

(1)

Section three of the principal Act is hereby amended by repealing paragraph (b) of subsection two, and substituting the following new paragraph:—

“(b)

Two members, one being a farmer and the other being a veterinary surgeon, shall be appointed as representing farmers’ veterinary clubs and associations and other like bodies, on the nomination of a majority of the delegates present and voting at a meeting held pursuant to section twelve a of this Act:”.

(2)

Each of the two members of the Council holding office as representatives of the Dominion Federation of Farmers Veterinary Services (Incorporated) on the passing of this Act shall, unless he sooner retires or otherwise vacates his office under the provisions of the principal Act, continue in office until the expiry of the term of office for which he was appointed, and shall be deemed to have been duly appointed under paragraph (b) of subsection two of the said section three (as enacted by subsection one of this section) as representing such clubs, associations, and other bodies as aforesaid.

(3)

Section five of the principal Act (which relates to extraordinary vacancies) is hereby amended by adding to subsection two the following proviso:—

“Provided that if at any time a vacancy is so created in the office of any member appointed under paragraph (b) of subsection two of section three of this Act, it shall not be necessary for any person to be appointed to fill the vacancy until the next meeting of delegates has been held pursuant to section twelve a of this Act; and until that time the vacancy may be temporarily filled by the appointment of some qualified person nominated by the Council, who shall hold office as a member of the Council until a member is appointed to fill the vacancy after the holding of that meeting.”

3 Council to hold annual meeting of delegates of certain farmers’ veterinary clubs and associations.

The principal Act is hereby further amended by inserting, after section twelve, the following new section:—

“12a

“(1)

The Council shall in each year hold a meeting of delegates of such farmers’ veterinary clubs and associations and other like bodies as are appointed in that behalf by the Council in accordance with subsection five of this section, for the purpose of discussing matters relating to the provision of efficient veterinary services for owners of live-stock in New Zealand.

“(2)

In addition to the meeting required by subsection one of this section, the Council may from time to time hold meetings of such delegates for the purpose aforesaid.

“(3)

The delegates at any meeting held under this section may, by resolution passed by a majority of the votes of such of them as are present and vote, make recommendations to the Council, in relation to any such matter as aforesaid, for its consideration.

“(4)

Whenever it is necessary for any person to be nominated by such delegates as aforesaid for appointment as a member of the Council the nomination shall be made at a meeting held under this section.

“(5)

The bodies to be appointed to send delegates to any meeting under this section shall be those farmers’ veterinary clubs and associations and other like bodies which in the opinion of the Council are so constituted and organized as to provide efficient veterinary services for their members and satisfactory working-conditions for veterinary surgeons employed by them. The number of delegates that each body so appointed may send to the meeting shall be determined by the Council.

“(6)

Every meeting under this section shall be held on such day and at such place as may be appointed by the Council. The day to be appointed for the meeting required by subsection one of this section shall be a day not later than the third Friday in the month of July.

“(7)

The Council shall cause notice in writing of the time and place appointed for the holding of any meeting under this section to be given to each club, association, or other body entitled under subsection five of this section to send any delegate thereto. The notice shall specify the number of delegates the body is entitled to send. The notice shall be given not later than twenty-one days before the day appointed for the holding of the meeting.

“(8)

Subject to the provisions of this Act, the Council may regulate the procedure and the conduct of business at every such meeting in such manner as it thinks fit.”

4 Rights and liabilities of the Crown under existing agreements with students for training in veterinary science transferred to Council.

(1)

Every agreement, being an agreement subsisting or in force on the passing of this Act, made between His Majesty the King and any person in respect of the payment of any moneys to or for the benefit of that person to enable him to undergo a course of study and training in veterinary science shall on the passing of this Act be deemed for all purposes to have been made between the Council and that person.

(2)

Every bond entered into by any person in favour of His Majesty the King, pursuant to any such agreement as aforesaid, and subsisting or in force on the passing of this Act shall on the passing of this Act be deemed for all purposes to have been entered into by that person in favour of the Council.

(3)

All references in any such agreement or bond as aforesaid to His Majesty the King or to the Crown or to the Minister shall be deemed to be references to the Council.

(4)

Nothing in this section shall apply to any agreement or bond relating to any grant of financial assistance to any person by the Rehabilitation Board pursuant to section eleven of the Rehabilitation Act, 1941.
