An Act to Amend the Canterbury Agricultural College Act, 1930.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title and commencement.

(1)

This Act may be cited as the Canterbury Agricultural College Amendment Act, 1949, and shall be read together with and deemed part of the Canterbury Agricultural College Act, 1930 (hereinafter referred to as the principal Act).

(2)

This Act shall come into force on the first day of January, nineteen hundred and fifty.

2 Constitution of Board of Governors.

(1)

Section six of the principal Act is hereby amended by repealing subsections two, three, and four, and substituting the following subsections:—

“(2)

The Board shall consist of—

“(a)

One member to be appointed by the Governor-General:

“(b)

Three members to be elected by such of the members of the Legislative Council as are for the time being resident in the Provincial District of Canterbury, together with such of the members of the House of Representatives as for the time being represent electoral districts wholly or partly within the said provincial district:

“(c)

Two members to be appointed by the Canter bury University College Council:

“(d)

One member to be appointed by the Council of the University of Otago:

“(e)

One member to be appointed by the governing bodies of such of the societies incorporated under the Agricultural and Pastoral Societies Act, 1908, as have their principal offices within the South Island:

“(f)

Three members to be appointed by Federated Farmers of New Zealand (Incorporated), of whom one member shall be appointed on the recommendation of the Provincial Executives of its Nelson, Marlborough, Golden Bay, and West Coast Branches; one member shall be appointed on the joint recommendation of the Provincial Executives of its South Canterbury, Mid-Canterbury, and North Canterbury Branches; and one member shall be appointed on the joint recommendation of the Provincial Executives of its Southland, Otago, and North Otago Branches:

“(g)

Three members to be elected by the graduates of the University of New Zealand whose names are on the books of the College and the holders of diplomas granted by the College:

“(h)

One member to be elected by the teaching staff of the College:

“(i)

The Principal of the College.

“(3)

Where at the time of the closing of the roll of electors prepared for the purposes of any election under paragraph (b) of the last preceding subsection there are, by reason of the dissolution or expiry of the then last Parliament, no members of the House of Representatives in office, the persons who were in office as members of the House of Representatives immediately before the dis solution or expiry shall be deemed for the purposes of the said election to have remained in office.

“(4)

For the purposes of this section, the expression ‘the teaching staff’ means the professors of the College, together with such of the full-time lecturers of the College as are for the time being entitled, pursuant to the Statutes of the University of New Zealand, to vote, as lecturers, at elections of the Academic Board of the University of New Zealand, and such of the instructors at the College as are recognized by the Board as members of the teaching staff for the purposes of this section.”

The members of the Board in office immediately before the date on which this Act comes into force shall all go out of office on that date.

3 Term of office of members of Board.

Section seven of the principal Act is hereby amended by repealing subsection two, and substituting the following subsection:—

“(2)

In the case of the members elected or appointed under paragraphs (b), (f), and (g) of subsection two of section six of this Act, one member shall in each case retire each year. The member to retire in each case shall be the member who has then been longest in office:

Provided that where two or more members have been in office for the same length of time as between those members the one to retire first shall be determined by lot.”

4 Election of members.

Section eleven of the principal Act, as amended by section five of the Statutes Amendment Act, 1944, is hereby further amended by omitting, from subsection two, the words “five rolls, one for the class of electors under paragraph (c) of section six hereof, and one for each of the three classes of electors under paragraph (d) of that section, and one for the class of electors under paragraph (e) of that section”, and substituting the words “three rolls, one for each of the classes of electors under paragraphs (b), (g), and (h) of subsection two of section six of this Act”.

5 Consequential repeals.
1938, No. 20

Section three of the Statutes Amendment Act, 1938, and section five of the Statutes Amendment Act, 1944, are hereby repealed.
