An Act to Amend the War Pensions Act, 1943.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title and commencement.

(1)
This Act may be cited as the War Pensions Amendment Act, 1949, and shall be read together with and deemed part of the War Pensions Act, 1943 (herein after referred to as the principal Act).
(2)
This Act shall be deemed to have come into force on the first day of June, nineteen hundred and forty-nine.
War Pensions
2 Maximum rates of pensions.

(1)
The principal Act (as amended by subsection one of section two of the War Pensions Amendment Act, 1946, and by section two of the War Pensions Amendment Act, 1947) is hereby further amended by repealing the First, Second, and Third Schedules, and substituting therefor respectively the First, Second, and Third Schedules set out in the Schedule to this Act.
Repeals.
(2)
The following enactments are hereby repealed namely:—
(a)
Subsection one of section two of the War Pensions Amendment Act, 1946, and the Second and Third Schedules to that Act:
(b)
Section two of the War Pensions Amendment Act, 1947, and the Schedule to that Act.
3 Increased pensions to children in certain cases.
Section thirty-one of the principal Act is hereby amended by omitting the words “twenty shillings”
, and substituting the words “twenty-five shillings”
.
4 Amending provisions as to adopted children.
Section thirty-two of the principal Act is hereby amended by repealing subsections one and two, and substituting the following subsection:—
“(1)
A pension in respect of the death or disablement of a member of the Forces may, in the discretion of the Board, be granted to any child adopted by the member.”
5 Amending provisions as to duration of pensions to children.
(1)
Section thirty-three of the principal Act is hereby amended by repealing subsection one, and substituting the following subsections:—
“(1)
A pension granted to or on behalf of a child of a member of the Forces in respect of his death or disablement shall commence on such day as the Board determines, being not earlier than the first day of the month in which the child is born.
“(1A)
Save as provided in this section, a pension granted to or on behalf of a child of a member of the Forces in respect of his death or disablement shall not continue after the end of the month in which the child has attained the age of sixteen years.”

The said section thirty-three is hereby further amended by inserting in subsection two, after the word “until”
, the words “the end of the month in which”
.
(3)
The said section thirty-three is hereby further amended by adding the following subsection:—
“(7)
Notwithstanding anything to the contrary in section seventy-two hereof, where a child to whom or on whose behalf a pension has been granted under this Act dies, the pension shall continue to the end of the month in which the child dies, and the amount (if any) unpaid on the date of the death of the child shall be paid to the person to whom the pension was payable on that date, or, in the discretion of the Board, to such other person as the Board thinks fit.”
6 Increasing pensions to guardians of motherless children.
Section thirty-six of the principal Act is hereby amended by omitting from subsection two the words “twenty shillings”
, and substituting the words “twenty-five shillings”
.
7 Increasing allowances for services of attendant.
(1)
Section forty of the principal Act (as amended by section four of the War Pensions Amendment Act, 1947) is hereby further amended by omitting from subsection one the words “five pounds ten shillings”
, and substituting the words “five pounds fifteen shillings”
.
Repeal. 1947, No. 26
(2)
Section four of the War Pensions Amendment Act, 1947, is hereby repealed.
Pensions in Respect of Service with Emergency Reserve Corps
8 Increasing maximum rates of Emergency Reserve Corps pensions.
1946, No. 17
Section fifty-seven of the principal Act (as amended by subsection two of section four of the War Pensions Amendment Act, 1946) is hereby further amended as follows:—
(a)
By omitting from paragraph (a) the words “thirty shillings”
, and substituting the words “thirty-five shillings”

(b)
By omitting from paragraph (b) the words “three pounds”
, and substituting the words “three pounds ten shillings”
:
(c)
By omitting from paragraph (c) the words “one pound a week”
, and substituting the words “one pound five shillings a week”
:
(d)
By omitting from the said paragraph (c) the words “one pound ten shillings”
, and substituting the words “one pound fifteen shillings”
.
War Veterans’ Allowances
9 Increasing rates of war veterans’ allowances.
1945, No. 12 1947, No. 26
(1)
Section sixty-two of the principal Act (as amended by section two of the War Pensions Amendment Act, 1945, and by section nine of the War Pensions Amendment Act, 1947) is hereby further amended by omitting the words “one hundred and seventeen pounds”
wherever they occur, and substituting in each case the words “one hundred and thirty pounds”
.
(2)
Section nine of the War Pensions Amendment Act, 1947, is hereby repealed.
