An Act to Amend the Crimes Act, 1908.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Crimes Amendment Act, 1950, and shall be read together with and deemed part of the Crimes Act, 1908 (hereinafter referred to as the principal Act).

2 Applying provisions of principal Act to aircraft.

The principal Act is hereby amended in the manner indicated in the Schedule to this Act.

3 Jury retiring to consider verdict.

Section four hundred and twenty-seven of the principal Act is hereby amended by adding to subsection one the following proviso:—

“Provided that for the purpose of having refreshment the jury may with the consent of the Court be taken under the charge of an officer of the Court to a place of public refreshment instead of remaining in a private place.”

Schedule Amendments of Principal Act to Apply Provisions to Aircraft

Section 2

Section Affected.	Nature of Amendment.
Section 2	By inserting, before the definition of the term “constable”, the following definitions:— “‘Aerodrome’, ‘aircraft’, and ‘air navigation’ have the same meanings respectively as in the Civil Aviation Act, 1948:”.
Section 199	By inserting, after the word “tramway” where it first occurs, the words “or on any aerodrome or in any aircraft”.
Section 199(a)	By inserting, after the word “tramway”, the words “or aerodrome”.
Section 199(b)	By inserting, after the word “tramway”, the words “or any aircraft”.
Section 199(c)	By inserting, after the word “person”, the words “or any aircraft”.
Section 199(d)	By inserting, after the word “tramway” wherever it occurs, the words “or aerodrome”; by omitting the word “thereon”, and substituting the words “on any railway or tramway, or to any aircraft on, or about to land on or take off from, any aerodrome”.
Section 199(e)	By inserting, after the word “tramway” wherever it occurs, the words “or aerodrome”.
Section 200	By inserting, after the word “tramway” where it first occurs, the words “or in any aircraft”.
Section 200(a)	By inserting, after the word “tramway”, the words “or any aircraft”.
Section 200(b)	By inserting, after the word “tramway”, the words “or any aircraft”.
Section 200(c)	By inserting, after the word “person”, the words “or any aircraft”.
Section 200(d)	By inserting, after the word “tramway” wherever it occurs, the words “or aerodrome”; by omitting the word “thereon”, and substituting the wards “on any railway or tramway, or to any aircraft on, or about to land on or take off from, any aerodrome”.
Section 200(e)	By inserting, after the word “tramway” wherever it occurs, the words “or aerodrome”.
Section 200 (f)	By adding the words “or in any aircraft”.
Section 329	By inserting, after the word “vessel”, the words “or aircraft”.
Section 333(a)	By inserting after the word “railway”, the words “or any aerodrome”.
Section 333(b)	By inserting, after the word “ship”, the words “or aircraft”.
Section 334(a)	By adding the words “or aerodrome”
Section 334(b)	By adding the words “or at any aircraft”.
Section 334(c) and (d)	By adding to each of these paragraphs the words “or aerodrome”.
Section 335(a)	By inserting, after the word “ship”, the words “or aircraft”.
Section 335(b)	By inserting, after the word “ship”, the words “or aircraft”.
Section 335(c)	By inserting, after the words “marine signal”, the words “or air signal”; by inserting, after the word “boat”, the words “or aircraft”.
Section 336	By inserting, after the word “ship”, the words “or aircraft”.
Section 337	By omitting the word “navigation”, and substituting the words “marine navigation or air navigation”.
Section 339(a)	By inserting in subparagraph (i), after the word “boat” wherever it occurs, the words “or aircraft”.
Section 339(b)	By inserting in subparagraph (i), after the word “ship”, the words “or aircraft”.
Section 339(c)	By inserting in subparagraph (i), after the word “ship” wherever it occurs, the words “or aircraft”; by omitting from subparagraph (ii) the word “navigation”, and substituting the words “marine navigation or air navigation”.
