An Act to amend the Apiaries Act 1927.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Apiaries Amendment Act 1951, and shall be read together with and deemed part of the Apiaries Act 1927 (hereinafter referred to as the principal Act).

2 Bees in walls of dwellinghouses, &c.

Section six of the principal Act is hereby amended by adding the following subsection:—

“(5)

In any case where bees have become established in the walls or any part of any dwellinghouse, shed, or building, an Inspector may direct the owner or occupier of the land on which the dwellinghouse, shed, or building is situated to destroy the bees and all bee combs connected therewith within a specified time. Every person who fails to carry out any direction given by an Inspector under this subsection within the specified time commits an offence and shall be liable on summary conviction to a fine not exceeding five pounds and to a further fine not exceeding one pound for every day during which the offence continues.”

3 Changing location of bees.

Section seven of the principal Act is hereby amended by adding to subsection one the following proviso as a proviso to the subsection:—

“Provided that a beekeeper may remove bees and appliances from one registered apiary to another registered apiary situated more than ten chains from where they were previously located for the purpose of the extraction of honey or for any other purpose of management if the bees and appliances and both apiaries are owned by the same person and are free from disease.”

4 Dealings with honey from an infected hive.

Section ten of the principal Act is hereby amended by adding to subsection two the words “or any honey from an infected hive in an apiary”.

5 Regulations.

Section sixteen of the principal Act is hereby amended by inserting in subsection one, after paragraph (b), the following paragraph:—

“(bb)

For the prohibition or regulation of the introduction into New Zealand, either generally or from any specified place, of bees or of any strain or strains of bees:”.
