An Act to amend the Government Railways Act 1949.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title.
1949, No. 40
This Act may be cited as the Government Railways Amendment Act 1955, and shall be read together with and deemed part of the Government Railways Act 1949 (hereinafter referred to as the principal Act).
2 General Manager of Railways.
1952, No. 82
Section five of the principal Act, as set out in section eight of the Government Railways Amendment Act 1952, is hereby amended by repealing subsection one, and substituting the following subsections:
“(1)
There shall from time to time be appointed a General Manager of Railways, who, in that capacity, under the control of the Commission, shall be the chief executive officer of the Commission and the Permanent Head of the Department.
“(1a)
Where the General Manager is also a Director, his office as General Manager shall become vacant immediately, if he resigns as a Director.”
3 Capacity of Directors and their deputies to hold positions in Department.

Section two of the Government Railways Amendment Act 1952 is hereby amended by adding to subsection five the following proviso:
“Provided that—
“(a)
A Director who at his appointment was a member of the Department may also be General Manager:
“(b)
A deputy of a Director who at his appointment as a deputy was a member of the Department may also hold any position within the Department:
“(c)
Any Director or deputy of a Director who holds any position within the Department in accordance with this proviso shall be a member of the Department while he holds the position.”
4 Term of office of Directors.
Section three of the Government Railways Amendment Act 1952 is hereby amended by adding to subsection one the following proviso:
“Provided that, where a Director is also General Manager, then, immediately he ceases to be General Manager, his office as a Director shall become vacant as if his term had expired, notwithstanding anything to the contrary in subsection two of this section and notwithstanding that the term for which he was appointed as a Director may not have expired; but he may thereafter be reappointed at any time as Director as if he were a member of the Department.”
5 Right of General Manager to attend meetings of Directors.
Section six of the Government Railways Amendment Act 1952 is hereby amended by inserting in the proviso to subsection eight, after the word “if”
, the words “the General Manager for the time being is not a Director or a deputy of a Director and”
.
