An Act to amend the Auckland Grammar School Act 1899.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title.
1899, (Local) No. 11
This Act may be cited as the Auckland Grammar School Amendment Act 1955, and shall be read together with and deemed part of the Auckland Grammar School Act 1899 (hereinafter referred to as the principal Act).
2 Name of Board.
(1)
Section three of the principal Act is hereby amended by omitting the words “Auckland Grammar School Board”
, and substituting the words “Auckland Grammar Schools Board”
.
(2)
The Board renamed by this section and reconstituted by section three of this Act is hereby declared to be the same Board as the Board which was named the Auckland Grammar School Board immediately before the commencement of this Act.
3 Constitution of Board.

(1)
The principal Act is hereby amended by repealing section four, and substituting the following section:
“4
Notwithstanding anything to the contrary in section eighteen of the Education Amendment Act 1948, the Board shall consist of—
“(a)
The Mayor for the time being of the City of Auckland:
“(b)
One member appointed by the Governor-General:
“(c)
One member appointed by the Auckland Education Board:
“(d)
One member appointed by the Professorial Board of the Auckland University College:
“(e)
Two members elected by the parents of the pupils of each of the schools under the control of the Board in the manner for the time being prescribed by the scheme for the control of the schools approved by the Minister under section ninety-two of the Education Act 1914:
“(f)
One member appointed by the Board itself.”
(2)
This section shall come into force on the first day of August, nineteen hundred and fifty-six.
4 Appointment and election of members.
The principal Act is hereby amended by repealing section five, and substituting the following section:
“5
“(1)
Subject to the provisions of this section, every appointed or elected member of the Board shall hold office for a term of two years, but may from time to time be reappointed or re-elected.
“(2)
Notwithstanding anything to the contrary in this Act, every appointed or elected member of the Board, unless he sooner vacates his office under section six of this Act, shall continue in office until his successor comes into office.
“(3)
On the thirty-first day of July, nineteen hundred and fifty-six all the elected members of the Board as it is then constituted shall go out of office, except the members elected under section eighteen of the Education Amendment Act 1948 by the parents of the pupils of each of the schools under the control of the Board, who shall be deemed to have been elected under paragraph (e) of section four of this Act.
“(4)
The first members to be appointed after the commencement of this section by the Governor-General, the Auckland Education Board, and the Professorial Board of the Auckland University College shall be appointed, and the additional members to be elected by the parents of the pupils of each of the schools under the control of the Board shall be elected, not later than the thirty-first day of July in the year nineteen hundred and fifty-six.
“(5)
The term of office of the members appointed by the Governor-General, the Auckland Education Board, and the Professorial Board of the Auckland University College, and of the members elected by the parents of the pupils of each of the schools under the control of the Board, shall expire with the thirty-first day of July in the year nineteen hundred and fifty-eight and with that day in every second year thereafter, and their successors (if then appointed or elected) shall forthwith thereafter come into office.”
5 Casual vacancies.
The principal Act is hereby amended by inserting, after section six, the following section:
“6a
“(1)
If any member of the Board dies or resigns or otherwise vacates his office, the vacancy shall be filled within sixty days by the appointment or election of a new member in the manner in which the vacating member was appointed or elected, and the member so appointed or elected to fill the vacancy shall be appointed or elected for only the residue of the term of the vacating member.
“(2)
The powers of the Board shall not be affected by any vacancy in the membership thereof.”
6 Repeals.
(1)
The following enactments are hereby repealed:
(a)
Section seven of the principal Act:
1928, No. 27
(b)
The Auckland Grammar School Amendment Act 1928.
(2)
This section shall come into force on the first day of August, nineteen hundred and fifty-six.
