An Act to amend the Control of Prices Act 1947
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Control of Prices Amendment Act 1956, and shall be read together with and deemed part of the Control of Prices Act 1947 (hereinafter referred to as the principal Act).
2 Exemption of goods from price control to be function of Minister
(1)
Section eighteen of the principal Act, as substituted by section three of the Control of Prices Amendment Act 1953, is hereby amended by omitting from subsection one the word “Tribunal”
, and substituting the word “Minister”
.
(2)
Section eighteen of the principal Act is hereby further amended by adding to subsection two the following paragraph:
“(c)
No Price Order shall be made or special approval given with respect to any goods for the time being deemed to be exempted from this Part of this Act as aforesaid.”
(3)
Section eighteen of the principal Act is hereby further amended by repealing subsections five, six, and seven, and substituting the following subsections:
“(5)
Any notice under subsection one of this section may be at any time amended or revoked by the Minister by a subsequent notice published in the Gazette.
“(6)
The Minister may, before publishing any notice under this section, refer to the Tribunal for investigation and report any matter which in the opinion of the Minister will assist him in making any determination under this section.
“(7)
The Tribunal shall carry out any investigation referred to it as aforesaid and for that purpose shall have all the powers which it has under this Act in the exercise of its other functions.”
(4)
Any notice under subsection one of section eighteen of the principal Act in force at the commencement of this Act shall be deemed to have been made under the said subsection one as amended by this section.
3 Delegation of powers of Tribunal
Section thirty-nine of the principal Act, as substituted by section four of the Control of Prices Amendment Act 1953, is hereby amended by omitting from subsection one the words “to give special approvals under section sixteen of this Act, but not including the power to make Price Orders”
, and substituting the words “to make Price Orders, and to give special approvals under section sixteen of this Act”
.
