An Act to amend the Waihou and Ohinemuri Rivers Improvement Act 1910

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Waihou and Ohinemuri Rivers Improvement Amendment Act 1958, and shall be read together with and deemed part of the Waihou and Ohinemuri Rivers Improvement Act 1910 (hereinafter referred to as the principal Act).

2 Money received under principal Act to be paid into Consolidated Fund

(1)

The principal Act is hereby amended by repealing section seventeen, and substituting the following section:

“17

All money received under this Act from the lease or sale of land, or as fees, charges, rent, or royalty or payment in respect of any right or concession granted by the Minister under this Act, shall be paid into the Public Account to the credit of the Consolidated Fund.”

The following enactments are hereby repealed:

(a)

Section twenty-seven of the Appropriation Act 1916:

(b)

Section six of the Finance Act 1919:

(c)

Section sixteen of the Finance Act 1922:

(d)

Section six of the Finance Act 1924:

(e)

Section seven of the Finance Act 1926:

(f)

Section four of the Finance Act 1928:

(g)

Section sixteen of the Finance Act 1930 (No. 2).

3 Expenses of constructing, improving, or maintaining works

(1)

The principal Act is hereby further amended by repealing section eighteen, and substituting the following section:

“18

All money required for constructing, improving, or maintaining works authorised by this Act shall be paid from the Public Account out of money appropriated by Parliament for the purpose.”

(2)

The following enactments are hereby repealed:

(a)

The Waihou and Ohinemuri Rivers Improvement Amendment Act 1912:

(b)

Section eighteen of the Finance Act 1922.

(3)

The debt owing to the Crown at the date of the passing of this Act by the Corporation of the Borough of Waihi pursuant to section eighteen of the Finance Act 1922 is hereby declared to be discharged.
