This Act may be cited as the Auckland Electric Power Board Amendment Act 1958, and shall be read together with and deemed part of the Auckland Electric Power Board Act 1921–22 (hereinafter referred to as the principal Act).

2 Minutes of Board

The principal Act is hereby amended by repealing section twenty-nine, and substituting the following section:

“29

“(1)

Minutes of the proceedings of the Board shall be kept in a book (the pages of which shall be numbered consecutively) which shall be kept in the office of the Board, and shall be open to inspection without fee during all office hours by any member or elector, or by any creditor of the Board.

“(2)

The minutes of the proceedings of the Board or of any committee, duly entered and authenticated as prescribed by the Board, shall be prima facie evidence of those proceedings and of the validity thereof.”

3 Special Orders

Subsection one of section thirty-one of the principal Act is hereby amended by repealing paragraphs (b) and (c) and substituting the following paragraphs:

“(b)

The resolution shall be confirmed at a subsequent meeting (either ordinary or special) held not sooner than the twenty-eighth day and not later than the seventieth day after the day of the first meeting:

“(c)

Public notices of the date, time, and place fixed for the subsequent meeting and of the purport of the resolution shall be given twice during the period of twenty-eight days immediately preceding the date of the subsequent meeting, with an interval of not less than fourteen days between the two notifications.”

4 Payments from Power Fund Account

(1)

Subsection two of section forty-eight of the principal Act is hereby amended by omitting the words “any two”, and substituting the words “any one”.

(2)

Subsection two of section forty-eight of the principal Act is hereby further amerided by adding the following proviso:

“Provided that for the purposes of meeting any emergency expenditure payments may be made without a prior resolution of the Board.”

(3)

Section forty-eight of the principal Act is hereby further amended by adding the following subsection:

“(3)

At each ordinary meeting of the Board there shall be submitted for its approval a list of all payments made under subsection two of this section without a prior resolution since the last preceding ordinary meeting of the Board.”

5 Balance sheets and accounts

Section fifty of the principal Act is hereby amended by adding the following subsection:

“(3)

The Board shall furnish to any person a copy of any statement and account prepared by the Board under this section on payment of such fee, if any, as the Board thinks fit, not exceeding sixpence for each folio of seventy-two words.”
