An Act to amend the Soil Conservation and Rivers Control Act 1941
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Soil Conservation and Rivers Control Amendment Act 1958, and shall be read together with and deemed part of the Soil Conservation and Rivers Control Act 1941 (hereinafter referred to as the principal Act).
2 Council or Tribunal to hear disputes, etc.
The principal Act is hereby amended by inserting, after section thirty-three, the following section:
“33a
“(1)
Where under this Act any matter is referred to the Council for decision the Council, if it thinks fit, may itself hear and decide the matter according to such procedure as it shall determine, or may appoint one or more persons, whether members of the Council or not, to be a Tribunal to hear and decide the matter. The decision of any such matter by a Tribunal so appointed shall have the same effect as a decision of the matter by the Council.
“(2)
For the purposes of inquiring into any matter the Tribunal shall have all the powers of a Commission of Inquiry under the Commissions of Inquiry Act 1908 and all the provisions of that Act shall apply as if the hearing of the matter were an inquiry under that Act.”
3 Remuneration and travelling allowances
(1)
The principal Act, as amended by subsection one of section ten of the Fees and Travelling Allowances Act 1951, is hereby further amended by repealing section eight, and substituting the following section:
“8
There shall be paid out of money appropriated by Parliament for the purpose to the members of the Council or of any Advisory or Technical Committee appointed under section eleven of this Act or of any Tribunal appointed under section thirty-three a of this Act (as enacted by section two of the Soil Conservation and Rivers Control Amendment Act 1958) remuneration by way of fees, salary, or allowances and travelling allowances and expenses in accordance with the Fees and Travelling Allowances Act 1951, and the provisions of that Act shall apply accordingly as if the members of each Advisory or Technical Committee or Tribunal (as well as the members of the Council) were members of a statutory Board within the meaning of that Act.”
(2)
The Second Schedule to the Fees and Travelling Allowances Act 1951 is hereby amended by repealing paragraph (a) of the portion of that Schedule which relates to the Soil Conservation and Rivers Control Act 1941.
