An Act to amend the Counties Act 1956
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Counties Amendment Act 1959, and shall be read together with and deemed part of the Counties Act 1956 (hereinafter referred to as the principal Act).
2 Constitution of county towns
Section four hundred and sixteen of the principal Act is hereby amended by inserting in subsection one, after the words “the acre”
, the words “or in which there are not less than sixty dwellinghouses with an average density of not less than one dwellinghouse to every three acres”
.
3 County town committee
(1)
Section four hundred and eighteen of the principal Act is hereby amended by repealing subsection two, and substituting the following subsections:
“(2)
The county town committee shall consist of such number of members, being not fewer than three nor more than seven, as the Council decides.
“(2a)
No person shall be eligible for appointment as a member of the county town committee, unless he is—
“(a)
A ratepayer having a qualification in respect of property situated within the county town; or
“(b)
An elector of the county having a residential qualification in respect of an address within the county town; or
“(c)
A member of the Council for the riding in which the county town is situated.”
(2)
Section four hundred and eighteen of the principal Act is hereby further amended—
(a)
By omitting from subsection three the words “ratepayers having a qualification in respect of property situated”
, and substituting the words “electors having a ratepayer’s qualification in respect of property within the county town or a residential qualification in respect of an address”
:
(b)
By omitting from the proviso to subsection four the words “a ratepayer having a qualification in respect of property situated in the county town”
, and substituting the words “qualified for appointment as a member of the committee”
:
(c)
By omitting from subsection five the words “ratepayer having a qualification in respect of property in the county town”
, and substituting the words “qualified person”
.
