An Act to amend the Nassella Tussock Act 1946

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title and commencement

(1)

This Act may be cited as the Nassella Tussock Amendment Act 1959, and shall be read together with and deemed part of the Nassella Tussock Act 1946 (hereinafter referred to as the principal Act).

(2)

This Act shall come into force on the first day of April, nineteen hundred and sixty.

2 Annual estimate of Board’s proposed expenditure

(1)

Section thirty-five of the principal Act is hereby amended by omitting from subsection one the words “an estimate to be prepared”, and substituting the words “to be prepared and sent to the Minister, in such form as he may require, an estimate”.

(2)

Section thirty-five of the principal Act is hereby further amended by repealing subsections four and five, and substituting the following subsections:

“(4)

The estimate prepared under this section shall be confirmed by resolution of the Board.

“(4a)

For the purposes of this section, the Minister may from time to time require the Board to send to him, for his confirmation, preliminary estimates in respect of any matters to be included in such annual estimate as aforesaid.

“(5)

The Minister may at any time approve or amend or require the Board to amend any preliminary estimate or annual estimate under this section.”

3 Restrictions on expenditure of Boards

Section forty-six of the principal Act is hereby amended by adding the following proviso:

“Provided that the Board shall not incur any expenditure in excess of two hundred and fifty pounds, or such other amount as may from time to time be fixed by the Minister of Finance, for any one purpose relating to the acquisition or development of any land or building or the acquisition of any equipment or plant, unless the Minister of Agriculture has previously consented to the expenditure.”
