An Act to amend the Social Security Act 1938

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Social Security Amendment Act 1960, and shall be read together with and deemed part of the Social Security Act 1938¹ (hereinafter referred to as the principal Act).

Part I Increasing Rates of Monetary Benefits

2 Commencement

Except as provided in section 13 of this Act, this Part of this Act shall be deemed to have come into force on the thirtieth day of March, nineteen hundred and sixty.

3 Increasing rate of age benefits

(1)

Section 16 of the principal Act is hereby amended by omitting from subsection (1) the words “two hundred and eight pounds”, and substituting the words “two hundred and twenty-one pounds”.

(2)

Section 4 of the Social Security Amendment Act 1958 is hereby repealed.

4 Maximum rate of additional age benefit for married man

(1)

Section 17 of the principal Act is hereby amended by omitting from the first proviso to paragraph (b) of subsection (2) (which proviso was substituted by section 5 of the Social Security Amendment Act 1954) the words “two hundred and eight pounds”, and substituting the words “two hundred and twenty-one pounds”.

(2)

Section 5 of the Social Security Amendment Act 1958 is hereby amended by repealing paragraph (b) of subsection (1).

5 Increasing rates of widows’ benefits

(1)

Section 23 of the principal Act (as substituted by section 2 of the Social Security Amendment Act 1946) is hereby amended as follows:

(a)

By omitting from paragraph (a) the words “two hundred and eight pounds”, and substituting the words “two hundred and twenty-one pounds”:

(b)

By omitting from subparagraph (i) of paragraph (b) (as substituted by section 7 of the Social Security Amendment Act 1957) the words “one hundred and forty-three pounds”, and substituting the words “one hundred and fifty-six pounds”.

(2)

Section 8 of the Social Security Amendment Act 1958 is hereby repealed.

6 Increasing rates of invalids’ benefits

(1)

Section 34 of the principal Act (as substituted by section 18 of the Social Security Amendment Act 1945) is hereby amended as follows:

(a)

By omitting from paragraph (a) of subsection (1) the words “two hundred and eight pounds” wherever they occur, and substituting in each case the words “two hundred and twenty-one pounds”:

(b)

By omitting from paragraph (b) of the same subsection the words “one hundred and sixty-nine pounds”, and substituting the words “one hundred and eighty-two pounds”:

(c)

By omitting from paragraph (c) of the same subsection the words “two hundred and eight pounds”, and substituting the words “two hundred and twenty-one pounds”:

(d)

By omitting from the proviso to paragraph (c) of subsection(2) the words “two hundred and eight pounds”, and substituting the words “two hundred and twenty-one pounds”.

(2)

Paragraph (b) of subsection (1) of section 10 of the Social Security Amendment Act 1957 and paragraphs (a), (b), and (d) of subsection (1) of section 11 of the Social Security Amendment Act 1958 are hereby repealed.

7 Increasing rates of miners’ benefits

(1)

Section 41 of the principal Act (as substituted by section 21 of the Social Security Amendment Act 1945) is hereby amended by omitting the words “two hundred and eight pounds” wherever they occur, and substituting in each case the words “two hundred and twenty-one pounds”.

(2)

Section 14 of the Social Security Amendment Act 1958 is hereby repealed.

8 Benefit to widow of deceased miner

(1)

Section 44 of the principal Act is hereby amended as follows:

(a)

By omitting from subsection (1) the words “one hundred and seventy-five pounds ten shillings”, and substituting the words “one hundred and eighty-eight pounds ten shillings”:

(b)

By omitting from subsection (2) the word “month”, and substituting the words “pay period”.

(2)

Section 15 of the Social Security Amendment Act 1958 is hereby repealed.

9 Increasing rates of sickness benefits

(1)

Subsection (2) of section 46 of the principal Act (as substituted by section 23 of the Social Security Amendment Act 1945) is hereby amended as follows:

(a)

By omitting from paragraph (a) the words “fifty-five shillings”, and substituting the words “sixty shillings”:

(b)

By omitting from paragraph (b) the words “eighty shillings” wherever they occur, and substituting in each case the words “eighty-five shillings”.

(2)

Paragraph (a) of subsection (1) of section 15 of the Social Security Amendment Act 1957 and section 16 of the Social Security Amendment Act 1958 are hereby repealed

10 Increasing rates of unemployment benefits

(1)

Subsection (1) of section 52 of the principal Act is hereby amended as follows:

(a)

By omitting from paragraph (a) the words “fifty-five shillings”, and substituting the words “sixty shillings”:

(b)

By omitting from paragraph (b) the words “eighty shillings” wherever they occur, and substituting in each case the words “eighty-five shillings”.

(2)

Section 16 of the Social Security Amendment Act 1957 and section 17 of the Social Security Amendment Act 1958 are hereby repealed.

11 Consequential amendments to limits of income and benefit

In respect of the period commencing with the thirtieth day of March, nineteen hundred and sixty, and ending with the eleventh day of October, nineteen hundred and sixty, the principal Act shall have effect as if it had been amended in the manner indicated in the First Schedule to this Act.

12 Authority to pay an additional benefit in certain cases

Notwithstanding anything in the principal Act, where any person is in receipt of a superannuation benefit in respect of the whole or any part of the period commencing with the thirtieth day of March, nineteen hundred and sixty, and ending with the eleventh day of October, nineteen hundred and sixty, and that person was previously in receipt of an age benefit, the Commission may in its discretion, on receipt of an application from the beneficiary, pay an additional benefit to that person not exceeding five shillings for every week or part thereof during the period that that person was in receipt of a superannuation benefit.

13 Validating payment of additional benefit in respect of period 12 October 1959 to 29 March 1960

(1)

Notwithstanding anything to the contrary in the principal Act, the Social Security Commission may, in its discretion, pay an additional benefit, not exceeding six pounds in the case of an unmarried person or twelve pounds in the case of a married person, to any person who was in receipt of an age, widow’s, invalid’s, miner’s, unemployment, sickness, or emergency benefit in respect of the whole or any part of the period which commenced with the twelfth day of October, nineteen hundred and fifty-nine, and ended with the twenty-ninth day of March, nineteen hundred and sixty.

(2)

This section shall be deemed to have come into force on the twelfth day of October, nineteen hundred and fifty-nine.

Part II Further Increases in Rates of Monetary Benefits

14 Commencement

This Part of this Act shall come into force on the twelfth day of October, nineteen hundred and sixty.

15 Increasing superannuation benefits

(1)

The principal Act is hereby amended by repealing section 13 (as substituted by section 3 of the Social Security Amendment Act 1958), and substituting the following section:

“(1)

Subject to the provisions of this Part of this Act, the rate of a superannuation benefit shall be two hundred and twenty-one pounds a year.

“(2)

In any case where a person in receipt of a superannuation benefit is unmarried, the Commission may, in its discretion, on receipt of an application from the beneficiary, increase the rate of the benefit by an amount of twenty-six pounds a year:

“Provided that the Commission may refuse to increase any benefit under this subsection in any case where in the opinion of the Commission the applicant is sharing household expenses with any other person.”

(2)

Section 3 of the Social Security Amendment Act 1958 is hereby repealed.

16 Abolition of property qualification and increasing income exemptions and limits of income and benefit

(1)

The principal Act is hereby further amended in the manner indicated in the Second Schedule to this Act.

(2)

Section 20 of the Social Security Amendment Act 1950 is hereby amended by omitting from subsection (1) the words “and the possession of accumulated property”.

(3)

The enactments specified in the Third Schedule to this Act are hereby repealed.

17 Provisions applicable on death of beneficiary

(1)

Section 75 of the principal Act is hereby amended by omitting from the second proviso to paragraph (a) of subsection (1) (which proviso was added by subsection (2) of section 16 of the Social Security Amendment Act 1954) the words “an age benefit, widow’s benefit, or invalid’s benefit”, and substituting the words “a widow’s benefit or an invalid’s benefit”.

(2)

Section 75 of the principal Act is hereby further amended by adding to subsection (1) (as amended by subsection (2) of section 16 of the Social Security Amendment Act 1954) the following additional proviso:

“Provided further that where any person, while in receipt of an age benefit, dies leaving a widow or widower or any dependent child or children the Commission may, in its discretion, continue the benefit to such date, not later than three months after the date of death of the beneficiary, as the Commission thinks fit.”

Part III Medical and Hospital Benefits and Other Related Benefits

18 Medical and hospital benefits and other related benefits for persons not ordinarily resident in New Zealand

Section 80 of the principal Act is hereby amended by adding the following subsection:

“(3)

Where the Minister is satisfied that persons ordinarily resident in New Zealand are or will be, while in any other country or territory, entitled (whether by agreement with the Government of that country or territory or otherwise) to claim benefits which substantially correspond to benefits provided for by this Part of this Act or to any of those benefits, he may, by notice in the Gazette, declare that persons ordinarily resident in that country or territory, not being the master or an officer or any other member of the crew of any ship, shall be entitled while in New Zealand to claim the several benefits provided for in this Part of this Act or any one or more of those benefits specified in the notice, and those persons shall be entitled accordingly to claim the benefit or benefits specified in the notice as if they were ordinarily resident in New Zealand.”

Section 34 (as substituted by section 18 of the Social Security Amendment Act 1945)	By repealing subsection (2), and substituting the following subsection: “(2) The rate of any benefit computed in accordance with subsection (1) of this section shall be reduced as follows: “(a) In any case where the applicant is a married man, by one pound for every complete pound of the total income of the applicant and of his wife in excess of one hundred and fifty-six pounds a year: “(b) In any case where the applicant is a married woman, by one pound for every complete pound of the total income of the applicant and of her husband in excess of three hundred and seventy-seven pounds a year: “Provided that where, by reason of the incapacity of the applicant, necessary domestic or nursing assistance is paid for, the Commission may, in its discretion, increase the rate of the benefit computed in accordance with this paragraph, but in any such case the rate of the benefit shall not exceed two hundred and twenty-one pounds a year and the total income of the applicant and of her husband (including the benefit) shall not exceed thirteen pounds ten shillings a week: “(c) In any other case, by one pound for every complete pound of the income of the applicant in excess of one hundred and fifty-six pounds a year.”
