An Act to amend the Hydatids Act 1959
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Hydatids Amendment Act 1960, and shall be read together with and deemed part of the Hydatids Act 19591 (hereinafter referred to as the principal Act).
2 New sections inserted
(1)
The principal Act is hereby amended by inserting in Part III, after section 29, the following heading and sections:
“Approved Organisations
“29a Borrowing powers of approved organisations
With the prior consent of the Council, any approved organisation may, in anticipation of its revenue, from time to time borrow money from its bankers by way of overdraft, or from any other person, for any purpose connected with the control, prevention, or eradication of hydatids.
“29b Banking of money
“(1)
Where money belonging to an approved organisation amounting to ten pounds or upwards comes into the hands of any person authorised to receive money on behalf of the organisation, that person shall within seven days after the money comes into his hands, or within such shorter period as the organisation from time to time directs, pay the same to the Treasurer of the organisation or to such other officer of the organisation as the organisation from time to time directs.
“(2)
All money received by the Treasurer or other officer of an approved organisation under subsection (1) of this section shall forthwith be paid into the Hydatid Control Account established by the organisation under subsection (2) of section 27 of this Act.
“(3)
No money shall be withdrawn from the bank except by authority of the approved organisation, and any cheque or other withdrawal notice shall be signed by the Treasurer or other officer of the organisation appointed for the purpose and countersigned either by a member or by an officer of the organization authorised by the organisation from time to time so to do.
“29c Accounts to be kept and audited
“(1)
Every approved organisation shall keep full and correct accounts of all money received and expended by it, and the accounts shall be audited by the Audit Office, which for that purpose shall have and may exercise all such powers as it has under the Public Revenues Act 1953 in respect of public money and the audit of local authorities’ accounts.
“(2)
Every approved organisation shall, as soon as possible after the end of every financial year, cause the accounts of the organisation to be balanced and full and true statements and accounts of all the money received and expended by the organisation during that year, and of the assets and liabilities of the organisation at the end of that year, to be prepared and submitted to the Audit Office.”
(2)
Section 27 of the principal Act is hereby amended by repealing subsection (5).
3 Offences
(1)
Section 32 of the principal Act is hereby amended by inserting, after paragraph (a) of subsection (2), the following paragraph:
“(aa)
Fails to comply with any notice given under paragraph (b) of subsection (1) of section 23 of this Act; or”.
(2)
Section 32 of the principal Act is hereby further amended by repealing paragraph (b) of subsection (2), and substituting the following paragraph:
“(b)
Fails within one month to comply with any notice or requirement under paragraph (c) or paragraph (d) or paragraph (f) of subsection (1) of section 23 of this Act or any notice under subsection (4) of section 24 of this Act; or”.
