An Act to make provision in connection with the attainment of independence by the people of Western Samoa

Preamble

Whereas at the date of the passing of this Act the Government of New Zealand is the administering authority for the Territory of Western Samoa under the Trusteeship Agreement for that Territory approved by the General Assembly of the United Nations on 13 December 1946:

And whereas the Trusteeship Agreement will terminate on 1 January 1962 and Western Samoa will thereupon become a fully independent sovereign State under the name of the Independent State of Western Samoa having a constitution which has been adopted by the people of Western Samoa:

And whereas it is expedient that provision be made declaring that Her Majesty shall have no jurisdiction over the Independent State of Western Samoa on and after the date on which the termination of the Trusteeship Agreement takes effect and for the repeal or amendment of such of the laws of New Zealand as would be incompatible with the status of Western Samoa as a fully independent sovereign State.

 
1 Short Title

This Act may be cited as the Western Samoa Act 1961.

2 Commencement

(1)

Except where this Act otherwise provides, this Act shall come into force at the hour of 11 o’clock in the evening on 1 January 1962, being the time in New Zealand corresponding to the commencement of 1 January 1962, in Western Samoa (that date being the date appointed by the General Assembly of the United Nations for the termination of the Trusteeship Agreement for the Territory of Western Samoa).

(2)

The period of 24 hours following the commencement of this Act is hereinafter referred to as Independence Day.

3 Independence of Western Samoa

It is hereby declared that on and after Independence Day Her Majesty in right of New Zealand shall have no jurisdiction over the Independent State of Western Samoa.

4 Future New Zealand Acts not to be in force in Western Samoa

No Act of the Parliament of New Zealand passed on or after Independence Day or passed before Independence Day and coming into force on or after Independence Day shall be in force in Western Samoa.

5 Application of New Zealand law to Western Samoa
[Repealed]

Section 5: repealed, on 6 October 1977, by section 6(2) of the Commonwealth Countries Act 1977 (1977 No 31).

6 Citizens of Western Samoa not required to register as aliens
[Repealed]

Section 6: repealed (with effect on 25 August 1970), on 27 November 1970, by section 3(2) of the Western Samoa Amendment Act 1970 (1970 No 123).

7 Abolition of appeals and cases stated to High Court

(1)

On and after Independence Day the High Court of New Zealand shall have no jurisdiction to hear or determine any appeal from any court in Western Samoa or any case stated by any court in Western Samoa.

(2)

Every appeal to the Supreme Court of New Zealand from the High Court of Western Samoa and every case stated by the High Court of Western Samoa for determination by the Supreme Court of New Zealand which is pending on Independence Day shall abate on that day.

8 Ordinances not invalid on ground of repugnancy with certain New Zealand Acts and regulations

(1)

Notwithstanding anything in paragraph (a) of subsection (1) of section 32 of the Samoa Amendment Act 1957, no Ordinance of the Legislative Assembly of Western Samoa and no provision of any such Ordinance shall be void or inoperative on the ground that it is repugnant to any provision of any enactment specified in Schedule 1, and for the purposes of that section the enactments so specified shall be deemed not to be reserved enactments.

(2)

Every Ordinance of the Legislative Assembly of Western Samoa passed before the date of the passing of this Act which would have been valid if this section had been in force when the Ordinance was passed is hereby declared to be valid.

(3)

This section shall come into force on the date of the passing of this Act.

9 Enactments amended

The enactments specified in Schedule 2 are hereby amended in the manner indicated in that schedule.

10 Repeals, revocations, and savings

(1)

The enactments specified in Schedule 3 are hereby repealed.

(2)

The regulations, rules, orders, and notices specified in Schedule 4 are hereby revoked.

(3)

On and after Independence Day the Western Samoa Order in Council 1920 (Gazette, 21 May 1920, p 1819) made by His late Majesty with the advice of the Privy Council on 11 March 1920, shall cease to have effect.

(4)

Notwithstanding the repeal or amendment or revocation of any enactment by this Act,—

(a)

the provisions of subsections (4) to (7) of section 75 of the Samoa Act 1921 shall continue to apply, as if this Act had not been passed, with respect to any memorial under that section filed in the Supreme Court of New Zealand before Independence Day:

(b)

every reception order made pursuant to section 328 of the Samoa Act 1921 with respect to any person who is subject to such an order immediately before Independence Day shall continue in full force and effect:

(c)

the Controller and Auditor-General may continue to exercise and perform all powers and functions conferred on him under any such enactment until the duties imposed on him by that enactment have been completed in respect of any period before Independence Day, and for that purpose every such enactment shall be deemed to continue in force as if this Act had not been passed:

(d)

the provisions of the British Nationality and New Zealand Citizenship Act 1948 shall apply with respect to every application received under that Act before Independence Day for registration as a New Zealand citizen or for a certificate of naturalisation as if this Act had not been passed.

1 General

This is a reprint of the Western Samoa Act 1961. The reprint incorporates all the amendments to the Act as at 1 April 1980, as specified in the list of amendments at the end of these notes.

2 Status of reprints

Under section 16D of the Acts and Regulations Publication Act 1989, reprints are presumed to correctly state, as at the date of the reprint, the law enacted by the principal enactment and by the amendments to that enactment. This presumption applies even though editorial changes authorised by section 17C of the Acts and Regulations Publication Act 1989 have been made in the reprint.

This presumption may be rebutted by producing the official volumes of statutes or statutory regulations in which the principal enactment and its amendments are contained.

3 How reprints are prepared

A number of editorial conventions are followed in the preparation of reprints. For example, the enacting words are not included in Acts, and provisions that are repealed or revoked are omitted. 4 Changes made under section 17C of the Acts and Regulations Publication Act 1989

Section 17C of the Acts and Regulations Publication Act 1989 authorises the making of editorial changes in a reprint as set out in sections 17D and 17E of that Act so that, to the extent permitted, the format and style of the reprinted enactment is consistent with current legislative drafting practice. Changes that would alter the effect of the legislation are not permitted.

A new format of legislation was introduced on 1 January 2000. Changes to legislative drafting style have also been made since 1997, and are ongoing. To the extent permitted by section 17C of the Acts and Regulations Publication Act 1989, all legislation reprinted after 1 January 2000 is in the new format for legislation and reflects current drafting practice at the time of the reprint.

In outline, the editorial changes made in reprints under the authority of section 17C of the Acts and Regulations Publication Act 1989 are set out below, and they have been applied, where relevant, in the preparation of this reprint:

  • omission of unnecessary referential words (such as “of this section” and “of this Act”)

  • typeface and type size (Times Roman, generally in 11.5 point)

  • layout of provisions, including:

    • indentation

    • position of section headings (eg, the number and heading now appear above the section)

  • format of definitions (eg, the defined term now appears in bold type, without quotation marks)

  • format of dates (eg, a date formerly expressed as “the 1st day of January 1999” is now expressed as “1 January 1999”)

  • position of the date of assent (it now appears on the front page of each Act)

  • punctuation (eg, colons are not used after definitions)

  • Parts numbered with roman numerals are replaced with arabic numerals, and all cross-references are changed accordingly

    • format of headings (eg, headings where each word formerly appeared with an initial capital letter followed by small capital letters are amended so that the heading appears in bold, with only the first word (and any proper nouns) appearing with an initial capital letter)

    • small capital letters in section and subsection references are now capital letters

  • schedules are renumbered (eg, Schedule 1 replaces First Schedule), and all cross-references are changed accordingly

  • running heads (the information that appears at the top of each page)

  • format of two-column schedules of consequential amendments, and schedules of repeals (eg, they are rearranged into alphabetical order, rather than chronological).
