This Act may be cited as the Electric Power Boards Amendment Act 1961, and shall be read together with and deemed part of the Electric Power Boards Act 1925¹ (hereinafter referred to as the principal Act).

Subsection (1) of section 27 of the principal Act is hereby amended by omitting the words “with the approval of the Minister”.

Subsection (1) of section 76 of the principal Act is hereby amended by omitting the words “and pursuant to such conditions as may be prescribed in that behalf by the Governor-General in Council”, and substituting the words “and on and subject to such conditions as may from time to time be imposed in that behalf by the Governor-General in Council.”

Section 76 of the principal Act is hereby further amended by inserting, after subsection (1), the following subsection:

All electric works constructed by any Board before the commencement of this Act shall be deemed to have been lawfully constructed under the authority of an Order in Council under section 76 of the principal Act and any such Order in Council which would have been valid if section 3 of this Act had been in force at the date of the Order in Council is hereby validated.

Nothing in this section shall be so construed as to relieve or to have relieved any Board from any obligation to comply with the requirements of any regulation or any requirement lawfully imposed under any regulation.

Section 90 of the principal Act is hereby repealed.
