An Act to amend the Wool Commission Act 1951
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Wool Commission Amendment Act 1961, and shall be read together with and deemed part of the Wool Commission Act 1951 (herein after referred to as the principal Act).
2 Appointment of members of New Zealand Wool Commission
Section 3 of the principal Act is hereby amended by repealing subsection (2), and substituting the following subsections:
“(2)
The Commission shall consist of seven members to be appointed by the Governor-General on the recommendation of the Minister, of whom—
“(a)
Two members, not being members of the Wool Board, shall be appointed after consultation with that Board:
“(b)
One member (not being a member of the Wool Board) shall be appointed on the nomination of that Board, such nomination having the approval of the Minister:
“(c)
Three members (being members of the Wool Board appointed as woolgrowers’ representatives) shall be appointed as representatives of the Wool Board on the nomination of that Board:
“(d)
One member shall be appointed as an associate member on the joint nomination of the New Zealand Woolbrokers Association and the Wool Board.
“(2A)
The member appointed under paragraph (b) of subsection (2) of this section shall be Chairman of the Commission.”
3 Transitional provisions
(1)
The first member to be appointed under paragraph (b) of subsection (2) of section 3 of the principal Act (as substituted by section 2 of this Act) shall be appointed as soon as may be convenient after the commencement of this Act, and the member holding office as Chairman of the Commission immediately before the commencement of this Act shall continue to hold that office until that member is appointed and shall thereupon cease to hold that office.
(2)
Notwithstanding the provisions of section 2 of this Act, every member of the Commission in office immediately before the commencement of this Act and appointed under paragraphs (a), (b), and (c) of subsection (2) of section 3 of the principal Act (as repealed by section 2 of this Act) shall be deemed to have been duly appointed as members of the Commission under paragraphs (a), (c), and (d) respectively of subsection (2) of section 3 of the principal Act (as substituted by section 2 of this Act).
(3)
The term of office of every person deemed by sub section (2) of this section to have been appointed a member of the Commission shall expire with the date on which, but for the passing of this Act, his term would have expired under the provisions of the principal Act.
This Act is administered in the Department of Agriculture.
