Order

1 Title

This order is the Social Security (Budget 2017—Rates of, and Areas for, Accommodation Supplement) Order 2017.

2 Commencement

(1)

This order comes into force on 1 April 2018.

(2)

However, clause 5(3) and (4) comes into force immediately after the commencement of clause 5(1).

3 Date from which clause 4 to have effect

In accordance with section 61H(2) of the Social Security Act 1964, clause 4—

(a)

has effect from 1 April 2018 (that is, from the beginning of 1 April 2018); and

(b)

applies to amounts payable or applicable on or after 1 April 2018.

4 Discretionary increases under section 61H of Social Security Act 1964 to maximum amounts of accommodation supplement

In each provision of the Social Security Act 1964 listed in the first column of Schedule 1 of this order, replace the amount set out opposite that provision in the second column with the amount set out opposite that provision in the third column.

5 Alterations under section 61I of Social Security Act 1964 to areas for accommodation supplement

(1)

In each provision of the Social Security Act 1964 listed in the first column of Part 1 of Schedule 2 of this order,—

(a)

omit any urban area or area unit set out opposite that provision in the second column; and

(b)

add in its appropriate alphabetical order any urban area or area unit set out opposite that provision in the third column.

(2)

In each provision of the Social Security Act 1964 listed in the first column of Part 2 of Schedule 2 of this order, add in its appropriate alphabetical order the urban area or area unit (that is no longer to be in Area 4) set out opposite that provision in the second column.

(3)

In each provision of the Social Security Act 1964 listed in the first column of Part 3 of Schedule 2 of this order,—

(a)

omit any urban area, urban zone, or area unit set out opposite that provision in the second column; and

(b)

add in its appropriate alphabetical order any urban area, urban zone, or area unit set out opposite that provision in the third column.

In each provision of the Social Security Act 1964 listed in the first column of Part 4 of Schedule 2 of this order,—

(a)

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 April 2018, makes—

discretionary increases under section 61H of the Social Security Act 1964 to maximum amounts of accommodation supplement:
alterations under section 61I of the Social Security Act 1964 to the areas (Area 1, Area 2, Area 3, and Area 4) for accommodation supplement.

The increases are made by clause 4 and Schedule 1.

The alterations are made by clause 5 and Schedule 2.

Schedule 2 has the following 4 Parts:

Part 1, which maintains parts of New Zealand in the same area despite new or altered definitions adopted by the Government Statistician:
Part 2, which moves specified areas or units from Area 4 to Area 2 or Area 3:
Part 3, which moves specified areas, zones, or units from Area 2 to Area 1:
Part 4, which moves specified areas, zones, or units from Area 3 to Area 2.

Part 1 of Schedule 2 is required because of the following new or altered definitions.

This order is a confirmable instrument, and an annual confirmable instrument, under section 47B of the Legislation Act 2012. It is revoked, or taken to have been invalid for past operation, at the close of 30 June 2018, unless earlier confirmed by an Act of Parliament. That stated time is the applicable deadline under section 47C(1)(a) of that Act.

This is a consolidation of the Social Security (Budget 2017—Rates of, and Areas for, Accommodation Supplement) Order 2017 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.

2 Legal status
