Contents
An Act to amend the Social Security Act 1938
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Social Security Amendment Act 1964, and shall be read together with and deemed part of the Social Security Act 1938 (hereinafter referred to as the principal Act).
Part I Increasing Allowable Income for Period 1 January 1964 to 8 September 1964
2 Increasing allowable income of beneficiaries in respect of period 1 January 1964 to 8 September 1964
(1)
In respect of the period commencing on the first day of January, nineteen hundred and sixty-four, and ending with the eighth day of September, nineteen hundred and sixty-four, the principal Act shall be deemed to have effect as if it had been amended in the manner indicated in the Schedule to this Act.
(2)
This section and the Schedule to this Act shall be deemed to have come into force on the first day of January, nineteen hundred and sixty-four.
Part II Increases in Rates of Monetary Benefits
3 Commencement of this Part
This Part of this Act shall be deemed to have come into force on the ninth day of September, nineteen hundred and sixty-four.
Superannuation Benefits
4 Increasing rate of superannuation benefits
(1)
Section 13 of the principal Act (as substituted by section 15 of the Social Security Amendment Act 1960) is hereby amended by omitting from subsection (1) the words “two hundred and thirty-four pounds”
, and substituting the words “two hundred and forty-nine pounds twelve shillings”
.
(2)
Section 42 of the Social Security Amendment Act 1963 is hereby repealed.
Age Benefits
5 Increasing rate of age benefits
(1)
Section 16 of the principal Act is hereby amended by omitting from subsection (1) the words “two hundred and thirty-four pounds”
, and substituting the words “two hundred and forty-nine pounds twelve shillings”
.
(2)
Section 43 of the Social Security Amendment Act 1963 is hereby repealed.
6 Increasing allowable income and rate of age benefit of married man
(1)
Section 17 of the principal Act is hereby amended—
(a)
By omitting from subsection (1) (as substituted by section 16 of the Social Security Amendment Act 1960) the words “one hundred and fifty-six pounds”
, and substituting the words “two hundred and eight pounds”
:
(b)
By omitting from paragraph (a) of subsection (2) the words “one hundred and fifty-six pounds”
, and substituting the words “two hundred and eight pounds”
:
(c)
By omitting from paragraph (b) of the same subsection the words “three hundred and ninety pounds”
, and substituting the words “four hundred and fifty-seven pounds twelve shillings”
:
(d)
By omitting from the first proviso to the same paragraph (as substituted by section 5 of the Social Security Amendment Act 1954) the words “two hundred and thirty-four pounds”
, and substituting the words “two hundred and forty-nine pounds twelve shillings”
.
(2)
The following enactments are hereby repealed:
(a)
So much of the Second Schedule to the Social Security Amendment Act 1960 as relates to paragraph (a) of subsection (2) of section 17 of the principal Act:
(b)
Section 44 of the Social Security Amendment Act 1963.
7 Allowable income of South African War veterans
(1)
Section 19 of the principal Act is hereby amended by omitting from the proviso the words “three hundred and ninety pounds”
, and substituting the words “four hundred and fifty-seven pounds twelve shillings”
.
(2)
Section 45 of the Social Security Amendment Act 1963 is hereby repealed.
Widows’ Benefits
8 Increasing rates of widows’ benefits
(1)
Section 23 of the principal Act (as substituted by section 2 of the Social Security Amendment Act 1946) is hereby amended—
(a)
By omitting from paragraph (a) the words “two hundred and thirty-four pounds”
, and substituting the words “two hundred and forty-nine pounds twelve shillings”
:
(b)
By omitting from subparagraph (i) of paragraph (b) (as substituted by section 7 of the Social Security Amendment Act 1957) the words “one hundred and sixty-nine pounds”
, and substituting the words “one hundred and eighty-four pounds twelve shillings”
.
(2)
Section 46 of the Social Security Amendment Act 1963 is hereby repealed.
9 Deductions from rates of widows’ benefits
Section 24 of the principal Act (as substituted by section 3 of the Social Security Amendment Act 1961) is hereby amended—
(a)
By omitting from paragraph (a) of subsection (1) the words “two hundred and sixty pounds”
, and substituting the words “three hundred and twelve pounds”
:
(b)
By omitting from paragraph (b) of subsection (1) the words “one hundred and fifty-six pounds”
, and substituting the words “two hundred and eight pounds”
.
Orphans’ Benefits
10 Increasing rate of orphans’ benefits
(1)
Section 27 of the principal Act is hereby amended by omitting from subsection (1) the words “one hundred and thirty pounds”
, and substituting the words “one hundred and thirty-seven pounds sixteen shillings”
.
(2)
Section 47 of the Social Security Amendment Act 1963 is hereby repealed.
Invalids’ Benefits
11 Increasing rates and income exemptions of invalids’ benefits
(1)
Section 34 of the principal Act is hereby amended—
(a)
By omitting from paragraph (a) of subsection (1) the words “two hundred and thirty-four pounds”
whereever they occur, and substituting in each case the words “two hundred and forty-nine pounds twelve shillings”
:
(b)
By omitting from paragraph (b) of the same subsection the words “one hundred and ninety-five pounds”
, and substituting the words “two hundred and ten pounds twelve shillings”
:
(c)
By omitting from paragraph (c) of the same subsection the words “two hundred and thirty-four pounds”
, and substituting the words “two hundred and forty-nine pounds twelve shillings”
:
(d)
By omitting from paragraph (a) of subsection (2) (as substituted by section 16 of the Social Security Amendment Act 1960) the words “one hundred and fifty-six pounds”
, and substituting the words “two hundred and eight pounds”

(e)
By omitting from paragraph (b) of the same subsection the words “three hundred and ninety pounds”

12 Allowable income for subsidy on earnings of blind beneficiary
(1)
Section 35 of the principal Act is hereby amended by omitting the words “five hundred and forty-six pounds”
, and substituting the words “six hundred and thirteen pounds twelve shillings”
.
(2)
Section 49 of the Social Security Amendment Act 1963 is hereby repealed.
Miners’ Benefits
13 Increasing rates of miners’ benefits
(1)
Section 41 of the principal Act (as substituted by section 21 of the Social Security Amendment Act 1945) is hereby amended by omitting the words “two hundred and thirty-four pounds”
wherever they occur, and substituting in each case the words “two hundred and forty-nine pounds twelve shillings”
.
(2)
Section 50 of the Social Security Amendment Act 1963 is hereby repealed.
14 Benefit to widow of deceased miner
(1)
Section 44 of the principal Act is hereby amended by omitting from subsection (1) the words “two hundred and one pounds ten shillings”
, and substituting the words “two hundred and seventeen pounds two shillings”
.
(2)
Section 51 of the Social Security Amendment Act 1963 is hereby repealed.
Sickness Benefits
15 Increasing rates and allowable income of sickness benefits
(1)
Subsection (2) of section 46 of the principal Act (as substituted by section 23 of the Social Security Amendment Act 1945) is hereby amended—
(a)
By omitting from paragraph (a) the words “sixty-five shillings”
, and substituting the words “seventy-one shillings”
:
(b)
By omitting from paragraph (b) the words “ninety shillings”
wherever they occur, and substituting in each case, the words “ninety-six shillings”
.
(c)
By omitting from the proviso (as substituted by section 6 of the Social Security Amendment Act 1961) the words “sixty shillings”
, and substituting the words “eighty shillings”
.
(2)
Section 52 of the Social Security Amendment Act 1963 is hereby repealed.
Unemployment Benefits
16 Increasing rates of unemployment benefits
(1)
Subsection (1) of section 52 of the principal Act is hereby amended—
(a)
By omitting from paragraph (a) the words “sixty-five shillings”
, and substituting the words “seventy-one shillings”
:
(b)
By omitting from paragraph (b) the words “ninety shillings”
wherever they occur, and substituting in each case the words “ninety-six shillings”
.
(2)
Section 53 of the Social Security Amendment Act 1963 is hereby repealed.
Part III Medical and Hospital Benefits and Other Related Benefits
17 Interpretation
Section 4 of the Social Security Amendment Act 1963 is hereby amended by omitting from the definition of the term “pharmaceutical benefits”
in subsection (1) the words “section 16”
, and substituting the words “section 15”
.
18 Persons entitled to claim medical and hospital benefits, etc
Section 6 of the Social Security Amendment Act 1963 is hereby amended by repealing subsection (3), and substituting the following subsection:
“(3)
If any question arises as to whether or not any person is ordinarily resident in New Zealand for the purposes of subsection (1) of this section, that question shall be referred to and be decided by the Minister.”
19 Entitlement to fees for general medical services
Section 8 of the Social Security Amendment Act 1963 is hereby amended by inserting, after subsection (1) the following subsection:
“(1a)
Where a medical practitioner in response to a call attends any person elsewhere than at the surgery or place of residence of the medical practitioner and that person either has died before the arrival of the medical practitioner or rejects the services of the medical practitioner, then, for the purposes of this section and of section 9 of this Act, that person shall be deemed to be a patient of the medical practitioner and the medical practitioner shall be deemed to have provided general medical services for that person.”
20 Fees for maternity services
Section 27 of the Social Security Amendment Act 1963 is hereby amended—
(a)
By omitting from subsection (3) the words “services rendered by him for which he is”
, and substituting the words “services rendered or to be rendered by him for which he is or will be”
:
(b)
By inserting in subsection (3), after the words “been passed”
, the words “or any fees in consideration of his accepting her as a patient”
.
Part IV Financial Provisions
21 Advances to beneficiaries and war pensioners for repair or maintenance of home
(1)
The principal Act is hereby further amended by repealing section 106a (as inserted by section 29 of the Social Security Amendment Act 1958), and substituting the following section:
“106a
“(1)
The Commission in its discretion may from time to time, out of the money appropriated for the purposes of paragraph (c) of subsection (2) of section 106 of this Act, make an advance of such amount, not exceeding two hundred pounds, and subject to such conditions as it thinks fit, to any beneficiary who is the owner of an estate in fee simple in any premises occupied by him as a home or is the lessee under a lease which is perpetually renewable of any premises occupied by him as a home, for the purpose of carrying out essential repairs to and maintenance of the premises or of providing essential services to the premises.
“(2)
For the purposes of this section—
“‘Beneficiary’ means any person who is in receipt of a benefit under Part II of this Act or of a pension or allowance under the War Pensions Act 1954 or the wife or husband of any such person:
“‘Lease’ includes a residence-site licence under the Mining Act 1926; and ‘lessee’ and ‘leasehold interest’ have corresponding meanings.
“(3)
Any advance under this section shall be a charge upon the estate or interest of the beneficiary in the land, and may be registered against the land under the provisions of the Statutory Land Charges Registration Act 1928.
“(4)
For the purposes of the Statutory Land Charges Registration Act 1928, notice of any charge under this section and any certificate releasing any such charge may be signed by any member of the Commission.
“(5)
Except with the consent of the Commission, no dealing in connection with any estate or interest in the land or, as the case may be, of the leasehold interest in the land (other than a transmission on the death of the beneficiary) shall be registered while a charge under this section is registered against the land or, as the case may be, that leasehold interest.”
(2)
The following enactments are hereby repealed:
(a)
Section 29 of the Social Security Amendment Act 1958:
(b)
Section 5 of the Social Security Amendment Act 1961:
(c)
Section 55 of the Social Security Amendment Act 1963.
