An Act to amend the New Zealand Council of Law Reporting Act 1938
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the New Zealand Council of Law Reporting Amendment Act 1964, and shall be read together with and deemed part of the New Zealand Council of Law Reporting Act 1938 (hereinafter referred to as the principal Act).
2 Constitution of Council
Section 7 of the principal Act is hereby amended by inserting in subsection (1), after paragraph (a), the following paragraph:
“(aa)
A Judge of the Supreme Court to be appointed by the Chief Justice:”.
3 Term of office of appointed members
(1)
Section 8 of the principal Act is hereby amended by repealing subsections (1) and (2), and substituting the following subsections:
“(1a)
Every member appointed by the Chief Justice shall be appointed for such term, not exceeding three years, as the Chief Justice may from time to time determine.
“(2)
Every member appointed by the Council of the New Zealand Law Society shall be appointed for such term, not exceeding four years, as that Council may from time to time determine.”
(2)
Section 8 of the principal Act is hereby further amended by omitting from subsection (4) the words “the next succeeding section”
, and substituting the words “section 8a or section 9 of this Act”
.
4 Extraordinary vacancies
(1)
The principal Act is hereby amended by inserting, after section 8, the following section:
“8a.
The office of a member of the Council appointed by the Chief Justice shall become vacant in any of the following circumstances:
“(a)
If he dies; or
“(b)
If he ceases to be a Judge of the Supreme Court; or
“(c)
If he resigns his office, by writing under his hand addressed to the Chairman of the Council or to the principal administrative officer of the Council.”
(2)
Section 9 of the principal Act is hereby amended by omitting from subsection (1) the words “an appointed member of the Council”
, and substituting the words “a member of the Council appointed by the Council of the New Zealand Law Society”
.
5 Proceedings of Council
(1)
Section 10 of the principal Act is hereby amended by inserting, after subsection (4), the following subsection:
“(4a)
If the member of the Council appointed by the Chief Justice is absent from any meeting of the Council, any Judge of the Supreme Court authorised in that behalf by the Chief Justice shall be entitled to attend the meeting, and while so attending shall be deemed to be a member of the Council.”
(2)
Section 10 of the principal Act is hereby further amended by omitting from subsection (5) the words “the Vice-President of that Society”
, and substituting the words “a Vice-President of that Society authorised by the Council of that Society”
.
