An Act to amend the Police Offences Act 1927
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Police Offences Amendment Act (No. 2) 1965, and shall be read together with and deemed part of the Police Offences Act 1927 (hereinafter referred to as the principal Act).
2 Restriction on use of word “Ruakura”
The principal Act is hereby amended by inserting, after section 22, the following section:
“22a. Restriction on use of word ‘Ruakura’
“(1)
Except with the consent of the Minister of Agriculture, no person shall sell any goods to which this section applies under any name, title, or description which contains the word ‘Ruakura’.
“(2)
Except with the consent of the Minister of Agriculture, no person who manufactures or sells any goods to which this section applies shall—
“(a)
Use any name, title, or description which contains the word ‘Ruakura’; or
“(b)
Publish or cause or permit to be published in respect of any goods to which this section applies any advertisement which—
“(i)
Refers to the goods by any name, title, or description which contains the word ‘Ruakura’; or
“(ii)
Is calculated or likely to cause any other person to believe that the goods were developed at the research institution administered by the Department of Agriculture and known as the Ruakura Agricultural Research Centre or that they were developed by any person while at any time employed in that institution.
“(3)
The goods to which this section applies are—
“(a)
Milking machines and parts of milking machines:
“(b)
Instruments or appliances designed for use with milking machines:
“(c)
Agricultural implements:
“(d)
Electric fences, and control units and parts of such fences:
“(e)
Stock food as defined in the Stock Foods Act 1946:
“(f)
Stock remedies as defined in the Stock Remedies Act 1934:
“(g)
Veterinary instruments and appliances:
“(h)
Agricultural chemicals as defined in the Agricultural Chemicals Act 1959:
“(i)
Scientific instruments and apparatus used for agricultural purposes.
“(4)
Every person who acts in contravention of this section commits an offence and shall be liable to a fine not exceeding two hundred pounds.
“(5)
Nothing in this section shall apply to the use by any individual of any name that was in use by him in New Zealand on the date of the commencement of this section.
“(6)
In any prosecution for an offence against this section it shall be for the defendant to prove that he acted with the appropriate consent or that the act complained of was not an offence by virtue of subsection (5) of this section.”
This Act is administered in the Department of Justice.
