An Act to amend the Counties Act 1956

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Counties Amendment Act 1965, and shall be read together with and deemed part of the Counties Act 1956 (hereinafter referred to as the principal Act).

2 County in which principal Act not in force

(1)

The principal Act is hereby amended by repealing section 4, and substituting the following section:

“4.

Except where this Act otherwise provides, this Act shall not apply to or be in force in the County of Fiord.”

(2)

The Counties Amendment Act 1961 is hereby amended—

(a)

By omitting from section 20 the words “Counties of Sounds and Fiord”, and substituting the words “County of Fiord”:

By omitting from the definition of the term “Council” in subsection (1) of section 21 the words “the County of Sounds or the County of Fiord that is not within the jurisdiction of a Road Board”, and substituting the words “the County of Fiord”:

By omitting from subsection (2) of section 21 the words “the County of Sounds or”:

(d)

By omitting from subsection (4) of section 35 the words “the County of Sounds or the County of Fiord that is not within the jurisdiction of a Road Board”, and substituting the words “the County of Fiord”:

(e)

By omitting from paragraph (a) of subsection (2) of section 44 the words “the County of Sounds or the County of Fiord that is not within the jurisdiction of a Road Board”, and substituting the words “the County of Fiord”.

3 Road district and Road Board

The principal Act is hereby further amended by repealing section 426, and substituting the following section:

“426.

The Waiheke Road District, constituted under section 11 of the Reserves and Other Lands Disposal and Public Bodies Empowering Act 1919, is hereby declared to be a road district under this Part of this Act; and the Road Board thereof is hereby declared to be a Road Board under this Part of this Act.”

This Act is administered in the Department of Internal Affairs.
