Contents
An Act to amend the National Provident Fund Act 1950
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the National Provident Fund Amendment Act 1966, and shall be read together with and deemed part of the National Provident Fund Act 1950 (hereinafter referred to as the principal Act).
2 Minister may become contributor on behalf of persons employed in Government Departments
(1)
Section 59 of the principal Act is hereby amended by adding to subsection (3) the words “and to persons employed by the Board as canvassing agents under section 14 of this Act”
.
(2)
This section shall be deemed to have come into force on the first day of December, nineteen hundred and sixty-five.
3 Election to surrender proportion of pension and receive cash payment
(1)
Section 73A of the principal Act (as inserted by section 9 of the National Provident Fund Amendment Act 1955) is hereby amended by repealing subsection (2A) (as inserted by section 2(3) of the National Provident Fund Amendment Act 1963), and substituting the following subsection:
“(2A)
Without restricting the provisions of subsection (2) of this section, it is hereby declared that an election under this section may be made by a person at any time within three months immediately preceding the date on which the person becomes entitled to a pension under this Act; and where such an election is made before that date it shall be deemed—
“(a)
Where the person is not a contributing employee, to have been made on that date; and
“(b)
Where the person is a contributing employee, to have been made on the earliest day on which the contributing employee would be entitled to a pension under this Act if he was living and had retired.”
(2)
Section 73A of the principal Act is hereby further amended by adding the following subsection:
“(4)
Except as provided in subsection (1A) of this section, any sum which a person is entitled to receive under this section instead of a proportion of a pension shall become payable on the date on which the person becomes entitled to the pension:
“Provided that where any person being a contributing employee dies on or after the date on which his election becomes effective but before a pension becomes payable, he shall for the purposes of this subsection be deemed to have become entitled to a pension on the date of his death.”
(3)
Section 2 of the National Provident Fund Amendment Act 1963 is hereby amended by repealing subsection (3).
(4)
This section shall be deemed to have come into force on the first day of April, nineteen hundred and sixty-six.
