An Act to amend the Civil Defence Act 1962

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Civil Defence Amendment Act 1967, and shall be read together with and deemed part of the Civil Defence Act 1962 (hereinafter referred to as the principal Act).

2 Civil defence traffic officers

(1)

Section 53A of the principal Act (as inserted by section 17 of the Civil Defence Amendment Act 1965) is hereby amended by repealing subsection (1), and substituting the following subsection:

“(1)

The Commissioner of Transport (with the consent of the Minister of Transport) and any local authority that employs full-time traffic officers may from time to time appoint such persons to be civil defence traffic officers as are considered necessary, and may train any persons so appointed.”

(2)

The said section 53A is hereby further amended by adding to subsection (2) the following additional proviso:

“Provided also that if he has been appointed by a local authority and does not, in addition, hold a warrant of appointment issued by the Commissioner of Transport, he may exercise that power and shall have that authority, duty, and responsibility only within the district of the local authority that appointed him.”

The said section 53A is hereby further amended by adding to subsection (3) the words “or of the appointing local authority, as the case may require”.

3 Local authority traffic officers to have extended authority during national emergency or major disaster

The principal Act is hereby further amended by inserting, after section 53A (as inserted by section 17 of the Civil Defence Amendment Act 1965), the following section:

“53B

“(1)

Notwithstanding anything to the contrary in the Transport Act 1962 or in any regulations for the time being in force under that Act, every person employed as a full-time traffic officer by a local authority shall have all the power, authority, duty, and responsibility of a traffic officer appointed by the Commissioner of Transport under the Transport Act 1962—

“(a)

During a state of national emergency, anywhere in New Zealand:

“(b)

During a state of major disaster, within the area in respect of which that state has been declared, and within any other area specified by the Commissioner of Transport, and within the district of the local authority that normally employs him.

“(2)

For the purposes of subsection (4) of section 53A of this Act, every person employed as a full-time traffic officer by a local authority, while engaged in carrying out civil defence work in accordance with subsection (1) of this section, shall be deemed to be holding an appointment under the said section 53A.”
