An Act to amend the Public Revenues Act 1953
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Public Revenues Amendment Act 1968, and shall be read together with and deemed part of the Public Revenues Act 1953 (hereinafter referred to as the principal Act).
2 Secretary may delegate powers
(1)
Section 9 of the principal Act is hereby amended—
(a)
By inserting in subsection (1), after the word “Treasury”
, the words “or such other person or persons”
:
(b)
By inserting in subsection (2), after the word “officer”
, the words “or other person”
.
(2)
The said section 9 is hereby further amended by repealing subsection (4), and substituting the following subsection:
“(4)
Any delegation under this section may be made to a specified officer or person or to officers or persons of a specified class, or may be made to the holder or holders for the time being of a specified office or appointment or class of offices or appointments.”
3 Time for laying information
The principal Act is hereby amended by inserting, after section 100, the following section:
“100a. Notwithstanding anything in section 14 of the Summary Proceedings Act 1957, any information in respect of any offence against this Act may be laid at any time within two years after the time when the matter of the information arose.”
4 Power to guarantee advances
Section 110 of the principal Act is hereby amended by adding the following subsection:
“(3)
For the purposes of this section, the giving of credit whereby any person to whom any amount is payable agrees that payment of the amount shall be made by instalments or deferred shall be deemed to be the making of an advance; and in any such case the person to whom the amount is payable shall be deemed to be the lender and the person by whom it is payable shall be deemed to be the borrower.”
This Act is administered in the Treasury.
