An Act to amend the Apple and Pear Marketing Act 1948

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title and commencement

(1)

This Act may be cited as the Apple and Pear Marketing Amendment Act 1968, and shall be read together with and deemed part of the Apple and Pear Marketing Act 1948 (hereinafter referred to as the principal Act).

(2)

This Act shall be deemed to have come into force on the first day of December, nineteen hundred and sixty-seven (being the date of the commencement of the Apple and Pear Marketing Amendment Act 1967).

2 Interest payable on money due to growers

Section 4 of the Apple and Pear Marketing Amendment Act 1967 is hereby amended by inserting, after subsection (3), the following subsection:

“(3a)

The Board may pay to the grower interest, at such rate as the Minister of Finance may approve, on any such amount in respect of the period beginning with the date of the reduction and ending with the date of the repayment of the amount.”

3 Apple and Pear Prices Authority

(1)

Section 18a of the principal Act (as inserted by section 5(1) of the Apple and Pear Marketing Amendment Act 1967) is hereby amended by adding the following subsections:

“(3)

The administrative costs of the Authority shall be paid by the Board.

“(4)

The Authority is hereby declared to be a statutory Board within the meaning of the Fees and Travelling Allowances Act 1951.”

(2)

Section 29 of the principal Act (as substituted by section 10(1) of the Fees and Travelling Allowances Act 1951) is hereby consequentially amended by inserting, after the words “appointed by the Board”, the words “and to the members of the Apple and Pear Prices Authority”.

This Act is administered in the Department of Agriculture.
